Details of Specific Committee Delegation

or Delegation contained in the relevant Sub-Scheme of Delegation.

Decision taken under the powers granted to the property officer under section 29.10 of the Council’s Financial Procurement Procedure Rules.

Paragraph 29.10.1 and 29.10.2 states where sufficient budget provision for an acquisition exists within the total Council budget, and the cost of the acquisition is less than £100,000 the Property Officer may approve a purchase of land or buildings in consultation with the relevant Cabinet Member.

Decision:

That the Assistant Director for Property and Facilities approves the acquisition of both of the sites identified on the plans at Appendix 1. Property and Facilities Services will manage the acquisition process with the proposed sellers, in consultation with the Council’s Section 151 Officer and the Cabinet Member for Transport, Jobs and the Local Economy.

Reasons for the Decision:

The land is required for the stabilisation works to a closed cemetery where the Council has a statutory duty to do the works.

Due to this direct approach to acquire the land by private treaty to satisfy S123 Local Government Act 1972 a valuation has been authorised internally by a Registered Valuer to determine the price to be paid by the Council.

It is recommended that the land is acquired by the Council to carry out the works required to stabilise the retaining wall.

The works will involve constructing a new retaining wall to stabilise the retained cemetery land.
