Appendix 9, Section 4C3, of the Council’s Constitution provides that “The Strategic Director of Adult Care, Housing and Public Health is authorised to discharge executive functions through the commissioning and provision of social services for adults and public health services for the whole population and delivery of housing for the Borough, including: (4) Strategic Commissioning; (a) Commissioning”. 

Brief Description of Decision:

To award a contract for the provision of the Rotherham Advocacy Service to Cloverleaf Advocacy 2000 Ltd, following a competitive procurement process, and approval of a Tender Evaluation Report.

Reasons for the Decision:

 

 

Independent advocacy services are necessary to meet all of the Council’s statutory requirements under the Care Act 2014, the Mental Capacity Act 2005, the Mental Health Act 2007 and the Health and Social Care Act 2012. Statutory independent advocacy services provide support to people:

·        who may require assistance throughout the care and support assessment and through the review process

·        who are the subject of an adult safeguarding enquiry or a safeguarding adults review and may experience difficulty in understanding the process,

·        who lack mental capacity to make decisions about themselves

·        who are detained under the Mental Health Act

·        who require support to complain about services provided by the NHS.

The current contractual arrangement ends 31st March 2025.  The recent competitive procurement process has secured ongoing service for a period of five years to 31st March 2030.
