Purpose:

On 28th March 2022 Cabinet agreed the following recommendations:

 

1.             That Cabinet authorise the acquisition of the Freehold and Leasehold interests in the land and properties shown edged red for identification purposes only on the plans at Appendix 1.

 

2.             That the Assistant Director for Planning, Regeneration and Transport be authorised to negotiate the acquisition by agreement of the property interests at Appendix 1, in consultation with the Council’s Section 151 Officer and the Cabinet Member for Jobs and the Local Economy, and the Assistant Director of Legal Services be authorised to complete the necessary transactions.

 

An agreement to acquire a parcel of land at Sheffield Road has now been reached and this report will exercise the delegation to agree Heads of Terms and complete the land transaction.

Exercising the delegations given by Cabinet on 28th March 2022 to the Assistant Director for Planning, Regeneration and Transport, as the Council’s designated Property Officer, to complete the negotiation and acquisition by agreement of the relevant property interests, in consultation with the Council’s Section 151 Officer and the Cabinet Member for Jobs and the Local Economy, and the delegation to the Assistant Director of Legal Services to complete the necessary transactions.

Brief Description of Decision:

 

 

Signing of the agreed Heads of Terms and completion of the necessary transactions to acquire the parcels of land identified in the report.

Reasons for the Decision:

 

 

To facilitate the continued development of regeneration in Rotherham town centre it is necessary to bring privately owned land into public sector ownership.

 

Agreement has now been reached with the private sector owner of the relevant land, and this delegation seeks to finalise the necessary transactions.

Details of alternative options considered and rejected:

 

The preferred option is to always acquire by agreement and negotiation is a mandatory precursor to any CPO action. This acquisition will enable land to come forward without the need to use CPO powers, thus significantly reducing the risk of needing to implement CPO powers.
