‘29.12. In respect of disposals of land and property the processes followed should be robust and transparent and in accordance with prevailing legislation. In all cases of planned disposal of land or property:

 

29.12.1. where the estimated disposal value is less than £100,000 the Property Officer, having taken financial and legal advice, may arrange for the disposal of land or property;

 

29.12.2. where the estimated disposal value of individual property assets is equal to or greater than £100,000, a decision of Cabinet is required;

Decision:

That the Assistant Director for Property & Facilities Services approves the disposal of the freehold interest in land at Far Field Lane, Wath to Barratt David Wilson Homes and to acquire land from the Fitzwilliam Wentworth Estates (FWE) to replace statutory allotments, to facilitate housing and infrastructure development.

 

Reasons for the Decision:

Cabinet agreed that the Assistant Director of Property and Facilities Services to negotiate and agree the terms and conditions of the proposed disposal and acquisition, but not the final disposal of the site. These terms have been negotiated and now the Assistant Director for Property and Facilities is wishing to carry out the disposal, as those terms are agreed and are favourable to all parties.

 

The agreed sale value, falls within the delegations afforded to the Assistant Director Property and Facilities (Property Officer), as detailed in this ODR.
