Decision:

Minded to Grant Decision:-  (1) That, in respect of its application to the Council’s Non-Executive functions relating to Licensing, the adoption of the revised General Enforcement Policy as detailed in Appendix 1 of the submitted report be approved and the final wording of the Appendix be clarified by the Strategic Director, Environment and Development Services.

 

(2) That the General Enforcement Policy be approved in respect of its application to the Council’s Executive Functions.

 

(3) That a monitoring report be submitted to a meeting of Commissioner Ney and the Advisory Licensing Board, during July, 2015, concerning the use and effect of the General Enforcement Policy as it affects the Council’s Licensing functions.

 

(4) That a monitoring report be submitted to Commissioner Manzie, concerning the use and effect of the General Enforcement Policy as it affects the Council’s other enforcement functions.

 

Reason:-  The Council is legally required, in the exercise of its regulatory function, to have regard to the statutory principles of good regulation that are reinforced in the Regulator’s Code. Accordingly the Council must have in place a Policy that provides how the Council will approach its enforcement/regulatory activities to comply. The report on governance in the Council, by Louise Casey, states that the General Enforcement Policy should give sufficient prominence to the need to protect the public.

Minutes:

Further to Minute No. 111 of the meeting of the Cabinet held on 17th December, 2014, consideration was given to a report presented by the Safer Neighbourhoods Manager, concerning the review of the Council’s general Enforcement Policy. The report highlighted the proposed changes to the General Enforcement Policy, as well the responses received to the public consultation exercise undertaken. The General Enforcement Policy was being revised and updated in accordance with the terms of the Regulators’ Code, published in April 2014 by the Government’s Better Regulation Delivery Office.

 

Resolved:- (1) That the report be received and its contents noted.

 

(2) That, in respect of its application to the Council’s Non-Executive functions relating to Licensing, the adoption of the revised General Enforcement Policy as detailed in Appendix 1 of the submitted report be approved and the final wording of the Appendix shall be clarified by the Strategic Director, Environment and Development Services.

 

(3) That the General Enforcement Policy shall be approved in respect of its application to the Council’s Executive Functions.
