EXCLUSION OF THE PRESS AND PUBLIC

The following item is likely to be considered in the absence of the press and public as being exempt under Paragraph 3 of Part 1 of Schedule 12A to the Local Government Act 1972 (as amended March 2006)(financial/business affairs).

Resolved:-  That, under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Paragraph 3 of Part 1 of Schedule 12A to the Local Government Act 1972 (as amended March 2006) (financial/business affairs).

Brookfield Park Phase 1 - Lifting of Restrictive Covenants

-           to request the lifting of the restrictive covenants.

Minutes:

Consideration was given to a report, presented by the Development Surveyor, detailing a request for the release of the restrictive covenants in relation to the Phase 1 development at Brookfield Park.

 

It was reported that the developer had already met the required construction of 24,000 sq ft of starter units.  The lifting of the restrictive convenants would enable the construction of a larger unit for which expression of interest had already been received and would thus facilitate inward investment.

 

It was confirmed that there were no direct financial implications to the detriment of the Council as the Developer had already paid market value for the land when purchased from the Council.

 

Resolved:-  That the request for the removal of the Restrictive Covenants, as detailed in the report now submitted, be approved.

 

(The Cabinet Member authorised that the above item shall be considered by this meeting, as a matter of urgency, in view of the impending Christmas and New Year office closure and the need to expedite this matter as soon as possible in January 2009)
