Consideration was given to a report presented by Phil Gill, Green Spaces Manager, which sought an exemption from Standing Orders 47.6.2 and 47.6.3 to allow orders to be placed with LDA Design and Alway Associates to advise the Council in preparing for and managing the adjudication brought by UCS Civils in respect of their terminated contract for the Clifton Park Restoration Project.

A summary was provided on the reason for the request, the assessment of the final account, the experience of the two specialist consultants and their previous involvement with Clifton Park.

It was also noted that since the report had been written the adjudication notice on the defined dispute had been received and an official adjudicator had been appointed.  

The Cabinet Member was in favour of the proposed appointments to address the challenges that would be forthcoming as part of the adjudication process.

Resolved:-  That the exempting of the proposed appointment of specialist consultants for Clifton Park from Standing Order 47.6.2 (requirement to invite at least two oral or written quotations for contracts with an estimated value of £5,000 but less than £20,000) and Standing Order 47.6.3 (requirement to invite at least three written quotations for contracts with an estimated value of £20,000 but less than £50,000) to allow orders to be placed with LDA Design and Alway Associates be approved.
