Exclusion of the Press and Public

 

The following items are likely to be considered in the absence of the press and public as being exempt under the Police Act 1997 and Paragraphs 3 and 7 of Part 1 of Schedule 12A to the Local Government Act 1972 (business affairs and prevention of crime)

Minutes:

Resolved:- That, under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in the Police Act 1997 and Paragraphs 3 and 7 of Part I of Schedule 12A to the Local Government Act 1972 (business affairs and prevention of crime).

49.

Applications for the Grant/Renewal/Review of Hackney Carriage/Private Hire Drivers' Licences

Minutes:

The Sub-Committee of the Licensing Board considered a report of the Licensing Manager relating to applications for the review/renewal of hackney carriage/private hire drivers’ licences in respect of Messrs. A.A., A.B., A.T. and K.H.

 

Mr.  A.A. and K.H., together with their representative, attended the meeting and were interviewed by the Sub-Committee.

 

Although in attendance, due to illness, consideration of Mr. A.B.’s case did not take place.

 

Resolved:- (1)  That a written warning be issued to Mr. A.A. enforcing his responsibility for the health and wellbeing of his passengers.

 

(2)  That consideration of the renewal application for a hackney carriage/private hire driver’s licence in respect of Mr. A.B. be deferred and he be afforded the opportunity of attending a future meeting of the Licensing Board Sub-Committee.

 

(3)  That consideration of the review application for a hackney carriage/private hire driver’s licence in respect of Mr. A.T. be deferred and he be afforded the opportunity of attending a future meeting of the Licensing Board Sub-Committee.

 

(4)  That the applications for the grant of a private hire/hackney carriage driver’s licence in respect of Mr. K.H. be refused.

50.

Application for the Grant of a Private Hire Operator Licence

Minutes:

Consideration was given to a report of the Licensing Manager, relating to an application for the grant of a private hire operator’s licence in respect of Mr.  K.L. (OLA UK Private Hire Ltd.).

 

Mr. G.L. attended the meeting and was interviewed by the Sub-Committee.

 

Resolved:- That the application for a private hire operator’s licence in respect of Mr. G.L. be approved subject to the following additional/amended conditions:-

 

(1)  That condition 3(a) be amended to include the following method of storage in relation to operator records;

 

An authorised electronic storage method – the use of which has been specifically agreed in writing by the Council’s Licensing Service.  This includes storage of data on remote servers, cloud storage and other similar storage methods.

 

(2)  That condition 3(b) be amended as follows:-

 

The name and address of the hirer (or in the case of app based bookings, the mobile phone or email address of the person making the booking).

 

(3)   That a local office be situated within the district controlled by Rotherham Metropolitan Borough Council (although the office did not necessarily need to be permanently staffed or accessible to members of the public);

 

(4)  That the app include information informing passengers which licensing authority their driver was licensed by;

 

(5)  All data stored within the app be retained for a period of 12 months;

 

(6)  Removal of condition 1(b) (in relation to the display of the licence in such a way as to be visible to members of the public) and condition 2(d) (in relation to a waiting area accessible by members of the public);

 

(7)  That journeys only be accepted that started and finished within the Rotherham area.
