Decision:

To extend the Rotherham Sexual Health contract to The Rotherham NHS Foundation Trust (TRFT) for 12 months as permitted in the contract terms.

Reasons for the Decision:

The decision is made in order to extend the sexual health contract, for 12 months from 1st April 2027 until 31st March 2028, implementing the required Consumer Price Index (CPI) uplift in line with the contractual terms and conditions.

The services delivered by TRFT through the contract are for health care services that fall within the procurement regime established by the Health Care Services (Provider Selection Regime) Regulations 2023 (PSR Regulations) that came into effect on 1st January 2024.

Although this decision is made after the 1st of January 2024, the Officer has been advised that the saving transitional arrangements set out in Regulation 29(3) of the PSR Regulations will apply to it and that they are satisfied. It follows that although the contract has been called off under a framework agreement made under the Public Contract Regulations 2015 (as amended), it is valid under the Health Care Services (Provider Selection Regime) Regulations 2023.

Details of alternative options considered and rejected:

Option 1 - recommended: To extend the contract for

one year, implementing the required CPI uplift and a

new Social Value commitment. The provider is

performing well and the contract allows the permitted

contract extension period.

Option 2 – not recommended: To extend the contract

for the full extension period of 5 years, with annual

reviews of the required CPI uplift and a new Social

Value commitment. The provider has confirmed a

preference for a one-year extension at this time, whilst

a financial review of the contract is

undertaken by TRFT.
