Brief Description of Decision:

 

 

Formal approval to submit an Application to the Department for Transport (DfT) for Moving Traffic Enforcement powers under Part 6 of the Traffic Management Act 2004. This will enable Designation of traffic management powers to the local authority for enforcement of moving traffic offences under the above Act.

Reasons for the Decision:

 

 

Submission of this application to DfT will enable Designation of traffic management powers to the local authority for enforcement of moving traffic offences under the above Act.

Details of alternative options considered and rejected:

 

Option 1: Do not apply to DfT for the powers to undertake the civil enforcement of moving traffic offences. This would leave enforcement of the stated traffic offences to the Police who have limited resources to deal with these issues and who cannot enforce the restriction 24/7.

 

Option 2: Apply to government for all sites initially considered even though there are a number of issues with regards on of the sites identified. If our application is rejected due to this site, the Council will have to wait for the next round of submissions to apply. There is currently no date specified for a further round of parliamentary decisions on these powers.
