Officers exercise delegated decision making powers in respect of both non-executive and executive functions of the Council.

The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

The Chief Executive and Strategic Directors of the Council have established their own sub-schemes of delegation detailing which and how both non-executive and executive functions will be discharged on behalf of the authority.

Recommendations

That approval be given to make the following changes to improve the financial offer for Foster Carers to support retention and recruitment of Foster Carers:

 

1.    To change the service model to provide a financial package for foster carers based on the needs of the child/ young person as well as the skills of the foster carer

2.    To make the following changes to the fees and allowances that foster carers receive:

a)    100% of skills payment to be paid for all children placed

b)    Increase to foster carer mileage rate from 40p per mile to align to employee rates, currently 45 pence per mile

c)    Agreement to the revised Day Care payment

d)    Uplift of the skills payments aligned to the annual inflationary uplift in the national fostering maintenance allowance

e)    Agreement to the complex care payment allowance e.g., for Step down to Foster Care and Emergency Foster Care for Teenagers in crisis

 

Decision:

1.    That the skills payments and maintenance allowances are increased in line with the NMA rates per age band for 2023/24.

Reasons for the Decision:

The Government set a National Minimum Allowance (NMA) for weekly child maintenance fostering rates based on age bands, these rates are increased annually.  The 2023/24 national increase has been set at 12.43%.  In 2021/22 and 2022/23 the national increase was 1.76% & 2.31% respectively.

 

This report considers the available options in increasing Fostering, Special Guardianship Orders (SGO), Child Arrangement Orders (CAO), Adoption Allowance (AA), respite, day care, and Fostering Skills payments in line with the governments recommended minimum uplift.

The Home Care and Support Service was secured via a competitive tender in 2019 and mobilised in April 2020.  Providers appointed to the Home Care and Support – Flexible Purchasing System were paid at hourly rates tendered in year 1 of the contract. 

 

In December 2021 the DHSC announced a Market Sustainability and Fair Cost of Care exercise with the objective of addressing care and support market sustainability issues.  The outcome of the FCoC was concluded with the results published 1 February 2023.  The FCoC relating to domiciliary care was £22.47/hr and the proposal that current hourly rates be aligned to this figure. 

 

It is proposed that a variable increase is applied to contracted hourly rates with bias towards providers who deliver service in the rural semi-rural areas of the Borough.   The detail of the resulting rates is included in Appendix 2 (exempt from publication).

Brief Description of Decision:

This proposal is recommended as it will address issues of severe capacity shortfall in certain geographic areas.  This option will also reduce the dependency on temporary contracted provision avoid fragmentation in the market and help to reset and stabilise the Home Care and Support Flexible Purchasing System.

Standardise the increase to contracted Home Care and Support provider  hourly rates based on the outcome of the FCoC exercise - median rate of £22.47/hr.

This option is not recommended as this would fail to stabilise the recruitment and retention issues and shortfall in capacity.

Reasons for the Decision:

To allow the Council to proceed with the award of the contract to the successful supplier so it can maintain its services and the use of hardware in order to help support meet the Councils requirements.

If the Council do not enter into a further call-off agreement, then it will become non-compliant with its own Financial and Procurement Procedure Rules and all future spend with Symology Ltd will be flagged as such.

Also without a further call-off agreement from 18 March 2023, the Council faces a significant business continuity risk, unable to manage activities on the highway, manage its highway repair programme and maintain a robust Highway safety inspection process.

As per Appendix D – Procurement Options Appraisal of the business case the following options were considered and rejected for the below reasons:

·     Above Threshold – Open Tender Process – There are compliant frameworks that the Council can utilise that meets its requirements.  The timescales that are set out in the Public Contract Regulations cannot be reduced therefore this is why the option is discounted

·     Above Threshold – Restricted Tender Process – There are compliant frameworks that the Council can utilise that meets its requirements.  Directorate Leads are keen to get this procurement exercise completed in a timely manner.  The timescales that are set out in the Public Contract Regulations cannot be reduced therefore this is why the option is discounted.

On 21 October 2019, Cabinet approved the development of 171 new homes across three town centre sites, including 20 homes for Shared Ownership at the site of the former Henley’s garage (now known as Wellgate Place).

Cabinet authorised “the Assistant Director of Housing in consultation with the Cabinet Member for Housing to make amendments to site boundaries and to the numbers, types and tenures of homes in the scheme.”

Reasons for the Decision:

The 11 shared ownership apartments at Portland House, Wellgate Place remain empty since handover in May 2022. Whilst the homes remain empty the Council continue to incur costs.

Shared ownership, was a key part of the Shared Ownership and Affordable Homes Programme 2016-21 (SOAHP), with the original prospectus setting out that grant funding bids would be expected to deliver circa 88% shared ownership.

This shared ownership expectation was later reduced by Homes England (the Homes and Communities Agency at that time) subsequently allowing general needs rented accommodation to be included, though the requirement for shared ownership was still substantial.

As grant funding support was essential in helping to address the viability of the overall programme, a shared ownership provision had to form a part of the Council’s build activity

Shared ownership however was not a significant part of the Rotherham housing market at that time and in being an early adopter, the Council effectively took on a market making role in delivering this tenure at reasonable scale into areas where shared ownership had little existing presence.

Learning from the delivery of the town centre programme has established that the market has reacted well to shared ownership houses, but not to shared ownership apartments.

The likelihood is that the combination of a mortgage requirement, payment of rent on the unowned share in addition to service charges on apartments may be too much for the market to bear in what is still a borough of relatively depressed market values. This is also reflected in other S/O schemes across the borough. Shared ownership houses generally have no, or minimal service charge obligations.

Details of alternative options considered and rejected:

The option of service charge reductions and incentivising sales has been dismissed, as the interest overall has been limited, it would require additional resources, and would be a further financial loss to the Council, with no guarantee of sales.

Several alternative tenure options were considered but as the property must remain as an affordable housing product to retain grant, a change to affordable rent offers the most expedient option in terms of governance and mobilisation, to reduce any further losses.

Brief Description of Decision:

 

 

The agreement is to provide a compliant contract for the service and maintenance of fire and security systems as detailed within the Procurement Business Case, which was approved by Simon Moss, Assistant Director, Planning Regeneration and Transport on the 5th December 2022.

Following the evaluation of this tender it is the recommendation of the project panel that the Council progresses to issue an award to DFP Services Ltd.

Reasons for the Decision:

 

 

The result of a competitive procurement process. The procurement process was undertaken as an open procurement procedure, which was conducted in line with the Public Contracts Regulations 2015 (as amended) and the Councils own Financial and Procurement Procedure Rules (FPPR’s)

Approval of this decision will allow the award of the contract to complete the TCF Manvers Cycleway project as part of the wider Transforming Cities Funding delivery.

Details of alternative options considered and rejected:

 

Option 1: Consideration was given to tendering as a wider package of works but this was unviable due to timescales.

 

Option 2: Use of the internal works delivery service was considered, but was ruled out due to programming constraints.
