Officer Decisions

Officers exercise delegated decision making powers in respect of both non-executive and executive functions of the Council.

The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

The Chief Executive and Strategic Directors of the Council have established their own sub-schemes of delegation detailing which and how both non-executive and executive functions will be discharged on behalf of the authority.

Decision records for the discharge of functions by officers are published below. These decision records set out the following information:-

Housing – Estate Services (a) Estate Management, incorporating Tenancy management, Sites and Estates management, Rent management, services to older people and all aspects of right to buy and leaseholder management

This decision was agreed in consultation with the three ward members of Boston Castle Ward, and Officers from the Councils Neighbourhoods Team and Strategic Housing and Development Service in October 2021. The names were submitted as part of the Planning Application in November 2021.

Decision:

The Town Centre Apartments were named as follows;

·       Wellgate Place, Block A – Portland House

·       Wellgate Place, Block B - Elizabeth House

·       Millfold Rise, Block A – Millfold Apartments

·       Westgate Riverside, Block A – Tom Burgess House

·       Westgate Riverside, Block B – Arthur Wharton House

Reasons for the Decision:

The three new Town Centre developments all contain apartments blocks within them and each block requires a name to help identify them as part of their postal address.

In the absence of an existing process/protocol at the time, the names were mutually agreed by the three ward members of Boston Castle Ward, and Officers from the Councils Neighbourhoods Team and Strategic Housing and Development Service in October 2021

The following reasons were given;

Portland House is located where the former Portland Terrace was situated

Elizabeth House relates to the connection with Wellgate Old Hall which was situated nearby in the 14th Century and received a Royal Charter from Queen Elizabeth I.

Millfold Apartments comes from the building previously occupying the site, Millfold House.

Tom Burgess House is named after Thomas William Burgess. A Rotherham man famous for being the second person to swim the English Channel in 1911. His statue used to be displayed at Sheffield Road baths before the site was cleared for re-development.

Arthur Wharton House is named after Arthur Wharton, the first black professional footballer. His first signing was with Rotherham United in 1889.

01/10/2021 - (ACX) Extension of partnership agreement with Migration Yorkshire ref: 1236    Recommendations Approved

Decision Maker: Assistant Chief Executive

Decision published: 14/10/2021

Effective from: 01/10/2021

Decision:

ROTHERHAM METROPOLITAN BOROUGH COUNCIL

RECORD OF OFFICER EXECUTIVE DECISION

Date of Decision:

1 October 2021

Decision Maker:

(Including Job Title)

Jo Brown, Assistant Chief Executive

Specific Delegation:

(If any)

Nonspecific

Brief Description of Decision:

That the existing partnership agreement with Migration Yorkshire be extended to include the provision of ‘wraparound’ support to Afghan guests in bridging accommodation.

Following the urgent evacuation of Afghan nationals following the fall of the country to the Taliban, emergency ‘bridging accommodation’ was set up in hotels across the UK, including a hotel in Rotherham.

Rotherham Council has an existing Partnership Agreement with Migration Yorkshire, following the Cabinet decision on 26 May 2016 to participate in the Vulnerable People’s Resettlement Scheme (VPRS). Under this arrangement, support is provided by the Refugee Council to those people resettled in Rotherham under the relevant programme. An extension was agreed to the arrangement in 2019, when RMBC agreed to take additional families under the VPRS.

The existing partnership arrangements will be extended to provide wraparound support for Afghan guest in bridging accommodation.

The wraparound support will be provided for a six-month period, with a break clause inserted after three months should the hotel no longer be in use. Should guests still be accommodated after three months, monthly reviews will be scheduled thereafter, to assess numbers with the fees amended proportionately.

Funding options have been explored with Finance Officers and there are sufficient funds in the Home Office funding allocation to support an extension to the existing agreement. Assurance has been given that mitigations are in place to minimise financial risks should hotel use cease prematurely.

Reasons for the Decision:

To ensure that appropriate wraparound support is provided to Afghan guests.

Details of alternative options considered and rejected:

The alternative option to continue the use of existing RMBC staff to provide wraparound support was rejected as it created thus approach created pressure on the delivery of other services as roles could not be backfilled. Council staff also to do not have access to the range of specialist support available through existing partnership arrangements.

28/04/2021 - Transportation of Children, Young People and Adults - Exemption to extend the procurement framework ref: 1233    Recommendations Approved

The existing procurement contract expired on 30.04.2021 and no application to extend the contract by way of an exemption has been processed to date. To allow sufficient time to consult with external transport providers, parents/carers of the children and apply the appropriate procurement process, a realistic timescale for renewal is September 2022.

In the interim, without an exemption, there is risk that existing provision and commitment/loyalty will be withdrawn, as operators seek more definite work or we may be subject to demands for increased rates, thus presenting a financial implication.

Any impact to existing provision, could also mean a risk to the safeguarding standards in place, as operators would not be accountable under the terms and conditions of engagement.

By granting this exemption, it allows the necessary timeframe to secure the existing provision, scope out the renewal programme, consider learnings from previous implementation and options for alternative procurement frameworks and ensure the stakeholders feel engaged and adequately consulted.

Brief Description of Decision:

That the request to grant an exemption to extend the procurement framework in relation for the contracts for Transportation of Children, Young People and Adults, be approved.

Reasons for the Decision:

The existing procurement contract expired on 30 April 2021 and no application to extend the contract by way of an exemption had been processed to date. In order to allow sufficient time to consult with external transport providers, parents/carers of the children and apply the appropriate procurement process, a realistic timescale for renewal is September 2022.

The granting of the exemption allows the necessary timeframe to secure the existing provision, scope out the renewal programme, consider learnings from previous implementation and options for alternative procurement frameworks and ensure the stakeholders feel engaged and adequately consulted.

Details of alternative options considered and rejected:

The alternative option of not granting an exemption was rejected as in the interim, without an exemption, there was a risk that existing provision and commitment/loyalty would be withdrawn, as operators sought more definite work there would be a risk that the Council may be subject to demands for increased rates for services in the future.

Brief Description of Decision:

That the Council instructs Muse development Ltd to commence detailed technical design of the Forge Island Leisure Scheme immediately on the basis that, should the Council decide not to progress with the scheme for any reason, Muse is indemnified against its abortive costs.

Reasons for the Decision:

To enable the next stage of the processes involved in the delivery of the Forge Island Leisure Scheme.

Details of alternative options considered and rejected:

The alternative option to continue with marketing activity to food and beverage operators, but to place detailed design on hold until heads of terms are agreed with occupiers was rejected as it was considered likely to be a longer route to delivering a start on site. This alternative option would have delayed the completion and opening of the scheme and, in the short term, would not have maximised the opportunity the scheme has to build on the current momentum in the market gained through the recent pre-letting announcements.

Brief Description of Decision:

1.    That the neighbourhood area application submitted by Firbeck Parish Council, as the relevant neighbourhood planning body, be approved.

2.    That Firbeck Parish be designated as a Neighbourhood Area.

Reasons for the Decision:

To enable the processes to enable the designation of Firbeck Parish as a Neighbourhood Area.

Details of alternative options considered and rejected:

Applications for neighbourhood plans are subject to a prescriptive process set out in central Government regulations. In this case, where a parish/town council applies for the whole of the area of the parish to be designated as a neighbourhood area, the local planning authority must designate the whole of the area applied for. As such, there were no other options to consider.
