The Chief Executive and Strategic Directors of the Council have established their own sub-schemes of delegation detailing which and how both non-executive and executive functions will be discharged on behalf of the authority.
Decision records for the discharge of functions by officers are published below. These decision records set out the following information:-

The site is subject to a licence agreement with the proposed purchaser, the owner of the adjacent property, The George Wright Boutique Hotel. It is recommended that the site is disposed of at the earliest time to the proposed purchaser, as this would generate a capital receipt and remove the Council’s liability / management of a site that has a limited future use. The future use of the site following a disposal will be a car park and storage accommodation.

Details of Specific Committee Delegation or Delegation contained in the relevant Sub-Scheme of Delegation.
|
Decision taken under the powers granted to the property officer under section 29.12 of the Council’s Financial Procurement Procedure Rules.
Paragraph 29.12.1 states where the estimated disposal value is less than £100,000 the Property Officer, having taken financial and legal advice, may arrange for the disposal of land or property.
|
Decision: |
That the Assistant Director for Property and Facilities approves the disposal of the site identified on the plan at Appendix 1. Asset Management will manage the disposal process with the proposed purchaser, in consultation with the Council’s Section 151 Officer and the Cabinet Member for Transport, Jobs and the Local Economy.
|
Reasons for the Decision: |
The site is currently subject to a licence agreement with the proposed purchaser, the owner of the adjacent property, The George Wright Boutique Hotel.
Due to this direct approach from the purchaser and to satisfy S123 Local Government Act 1972 a valuation has been completed by the District Valuer to determine the price to be paid by the purchaser. It is recommended that the site is disposed of to the proposed purchaser, as this will generate a capital receipt and remove the Council’s liability / management of a site that has a limited future use.
The proposed future use of the site following its disposal will be a car park and storage accommodation in association with The George Wright Boutique Hotel.

Decision: |
That the Assistant Director for Property & Facilities Services approves the disposal by agreement of the freehold interest of 167 Canklow Road in consultation with the Council’s Section 151 Officer and the Cabinet Member for Transport, Jobs, and the Local Economy
|
Reasons for the Decision: |
Under the Leasehold Reform Act 1967, a leasehold property owner has the statutory right to either extend the length of their existing lease or to purchase the freehold title to their property. Given the direct approach from the leaseholder, the only option is to dispose of the freehold interest in the property. The long leaseholder in this instance is exercising their statutory right to purchase the freehold. Approval is sought to dispose of the freehold interest in 167 Canklow Road, Canklow for £590 plus a contribution towards the Councils professional fees. |
