The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

To allocate the Workforce Recruitment and Retention Fund October 2021 in the following three areas:

 

1. £288,000 to commission a Rapid Response Service Winter Pilot from 3 of the current FPS framework of providers. An Exemption to Finance and Procurement Procedure Rules is required to direct award and the levels of capacity, capability and interest will be taken into consideration when choosing the providers.

 

2. £553,372 to CQC registered providers, registered in Rotherham, on a per staff number basis - using data from the NHS Capacity Tracker.

 

To be used to deliver measures that address local workforce capacity pressures through recruitment and retention activity.

 

3. £69,500 to the Council’s accommodation based services (these services will be excluded from receiving an allocation from the funds described at 2).

 

The allocation will support with staff retention/ recruitment and address the difficult capacity issues in relation to delivery of critical services, in alignment with the Council’s specific Provider Services winter planning. 

 

Providers will be asked to certify the expenditure at the end of the reporting period and any unspent allocations will be returned to the Council.

 

Any unspent grant funding will then be returned to Government.

 

Reasons for the Decision:

 

 

On the 3 November 2021, the Department of Health and Social Care (DHSC) published details of the Workforce Recruitment and Retention Fund.

 

The Fund covers the period 1 October 2021 to 31 March 2022 and will provide an additional £162.5 million to support Adult Social Care.

 

Rotherham’s total allocation is £910,872 and will be received in two tranches. Therefore, any payments made to providers will also be made in two tranches in December 2021 (60%) and Jan/Feb 2022 (40%).

 

The Fund has clear eligibility criteria, is time limited, and all spend, and activity must be completed by 31 March 2022.

 

There are no mandatory elements to the Fund and Councils are required to determine themselves how the monies are distributed. There is however clear guidance on the type of activity that the money can be spent on.

 

The Council has facilitated the distribution of the Workforce Recruitment and Retention Fund October 2021 in accordance with the grant conditions. This is recorded via the Record of Officer Executive Decision from the Strategic Director of Adult Care, Housing and Public Health.

The South Yorkshire and Bassetlaw Integrated Care System (ICS) has released some non-recurrent funding to support Adult Social Care over the winter period.

 

Rotherham has been allocated £1.76m to enact a market uplift across Adult Social Care Services, brought forward from the inflationary increases due as of 1 April 2022 (subject to Council approval of the Budget) to 1st December 2021. These uplifts include a 6.62% increase on the staffing element of providers costs, which will incorporate the introduction of the National Living Wage (NLW) increase before 1April 2022.

 

The Decision proposes increasing the rate paid for Care Provision using this funding when paying for Adult Social Care provision.  

 

This decision only covers the period December 2021 to March 2022 as any continuation is subject to Council approval of the Budget.  Increasing fee rates before the new financial year has only been made possible due to the additional funding from the ICS and won’t be repeated in future years unless further additional funding is provided.

 

Reasons for the Decision:

 

 

The purpose of the funding is to support the continued workforce challenges across the Adult Social Care market, by encouraging people to remain in or join the sector with competitive rates of pay.

 

The total uplift proposed for each sector is based on a weighted average cost incorporating the NLW increase and CPI, with the exception of respite and shared lives where the cost of services are managed differently. Older people’s care homes and home care providers will receive an additional increase following the detailed cost of care review in 2020/21 which provided for supplementary increases over 3 years (referenced in last year’s Budget).

 

Discussions with care providers have highlighted that the ability to pay staff a competitive rate is a key issue, especially in view of the significant wage inflation within retail, hospitality, and the NHS.

To allocate 70% (£437,000) of the Rapid Testing Fund Round IV in accordance with the mandatory grant conditions, and to distribute the 30% (£169,000) discretionary element as set out below.

 

Additional guidance has been issued indicating that £62,000 of the 30% discretionary element should be ringfenced for Community Care providers in respect of the associated costs of PCR testing.

 

It is proposed to offer a range of organisations the opportunity to bid for a grant from the discretionary fund.

 

These organisations are:

 

·       Any CQC registered provider of residential care to adults with a registered location in Rotherham.  This includes care homes for older people and under 65 provision, including smaller homes to implement lateral flow testing as they may face relatively higher costs compared to larger homes.

·       Supported Living Providers.

·       Extra Care Housing Providers.

 

The above is in line with the conditions of the 30% discretionary grant.

 

In terms of reviewing the applications, these will be considered in this order of priority:

 

·            Supported Living Providers – providers not able to access the 70% mandatory grant.

·            Extra Care Housing Providers – providers not able to access the 70% mandatory grant.

·            Smaller care homes – as they may face relatively higher costs compared to larger homes.

·            Any CQC registered provider of residential care to adults with a registered location in Rotherham.  This includes larger care homes for older people and under 65 provision.

 

For care homes, the provider will need to have spent (or forecast to have spent due to the timescales of the reporting) their mandatory allocation (70% element).

 

This element will be allocated based on an assessment of the emerging risks, and in line with the wider testing strategy.

 

The providers will be asked to certify actual expenditure at the end of the reporting period and any unspent allocations returned to the Council.

 

Any unspent grant funding is to be returned to Government.

30/11/2021 - (R&E) Report of objections to proposed Traffic Regulation Orders associated with the A633 High Street-Bellows Road access improvement Clean Air Zone scheme ref: 1255    Recommendations Approved

To inform the Strategic Director of Regeneration and Environment of the outcome of the Traffic Regulation Order (TRO) consultations on proposed bus lanes, prohibited U-turns, waiting and parking restrictions and report receipt of objections. To then recommend that the proposals be implemented with minor amendments.

 

In the Summer of 2021 public consultation was undertaken on TRO proposals associated with the High Street-Bellows Road access improvement scheme. This was developed to deliver the Clean Air Zone (CAZ) requirements mandated by government for A633 Rawmarsh Hill by assisting with the partial redirection of bus services to meet air quality requirements. This CAZ proposal was consulted on in 2019.

 

The 2021 TRO consultation resulted in several objections to these specific proposals and the scheme in general to introduce traffic signal control at the junction.

 

In order to deliver the maximum benefits from the scheme by also promoting bus priority and providing improved pedestrian crossing facilities the scheme and associated TROs should be delivered. The report will explain which elements are still considered to be required and recommend that the objections are not acceded to and the proposed Traffic Regulation Orders are implemented

The decision is to award the contract for the refurbishment of the Herringthorpe stadium in line with the tender evaluation report.

 

The works are being funded and approved from the Regeneration and Environment Services (R&E) Capital Programme 2019-24 (approved at the Council meeting on the 26February 2020 which included the sum of £254,000  for Herringthorpe Stadium and in addition there is an allocation from the Operational Estates Maintenance Capital Budget (as approved V10 SOP) of £110,000 for refurbishment of the building at Herringthorpe Stadium with a further allocation of £68,217 (as approved in V13 SOP) identified to fund this project.

This project was procured using the Rotherham Construction Partnership4 (RCP4) framework. The RCP4 Framework is OJEU compliant and was procured by the Council. The procurement of the RCP4 framework was approved by the Acting Strategic Director of Regeneration and Environment on 04/12/2018. The decision to award the RCP Framework was approved by the Strategic Director on 3rd June 2019. In line with the procurement regulations, all the contractors within the relevant Lot are invited to submit a tender price.

 

The procedure was conducted in line with the Public Contract Regulations 2015 and the Council’s own Financial and Procurement Procedure Rules.
