Officer Decisions

Officers exercise delegated decision making powers in respect of both non-executive and executive functions of the Council.

The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

The Chief Executive and Strategic Directors of the Council have established their own sub-schemes of delegation detailing which and how both non-executive and executive functions will be discharged on behalf of the authority.

Decision records for the discharge of functions by officers are published below. These decision records set out the following information:-

Executive functions – Procurement (c) To make decisions in relation to commissioning and procurement activity. Such activity should be carried out in accordance with the Finance and Procurement Procedure Rules.

Decision:

To award a 3-year contract and appoint Phoenix Software Ltd to provide the Council’s Corporate data backup solution, at a value of £727,815.

Reasons for the Decision:

Following evaluation of the procurement options against the Council’s requirements, the Council decided to run a further competition via the HealthTrust Europe (HtE) framework; Enterprise Level ICT Digital Technology Solutions 2023 (ComIT 3 – Complete IT 3); Framework Reference 2023/S 000-007857. Following evaluation of compliant tender submissions, Phoenix Software Ltd was determined the most economically advantageous.

Details of alternative options considered and rejected:

An alternative procurement framework (Commercial Services Group Ltd) was considered an option, however, a further competition under this framework was not considered viable due to the complexity and time implications of engaging 24-suppliers in a further competition which would delay the evaluation process, conflicting with the required procurement timeline.

RECORD OF OFFICER EXECUTIVE DECISION

Date of Decision:

Title:

First Homes Fee Charging Schedule

Decision Maker:

(Including Job Title)

Andrew Bramidge

Strategic Director of Regeneration and Environment

Details of Specific Delegation

or

Delegation contained in the relevant Sub-Scheme of Delegation.

Cabinet approval, meeting held on 25th April 2022 (para 138, Resolution 4):

That Cabinet approves delegation to the Strategic Director for Regeneration and Environment, in consultation with the Cabinet Member for Jobs & the Local Economy, to amend the First Homes eligibility criteria and fee charging systems as required by monitoring and review.

Decision:

To increase the First Homes fee, which is charged to

Housing Developers from £1,077 per unit to £1,329 per

unit.

The Local Eligibility Criteria for First Homes will remain in place as outlined in the Interim Policy Statement.

Reasons for the Decision:

The increase in the First Homes Fee is to cover increased staff costs for dealing for the administration of the scheme.  The First Homes fee pays for mandatory Council administration support in dealing with the initial sale of a First Home and 2 x subsequent resales.  After this the Council’s administration costs are borne by the Vendor/Purchaser.

The Local Eligibility Criteria was adopted by the Council to give priority to applicants with a connection to Rotherham to purchase a First Home. The criteria applies for the initial 3 months that a First Home is marketed by the developer and every resale thereafter.  It is conditioned by way of a restriction on the title deeds of the property.  Evidence from the sales data for First Homes shows that of the 45 units that have been sold/ reserved, 35 of them (77%) have been sold in the initial 3-month period to people who meet one or more conditions of the Local Eligibility Criteria.

Details of alternative options considered and rejected:

Do nothing.

This option will leave the First Homes Fee Charging Schedule unchanged and retain the Local Eligibility Criteria.

This option will mean that the Council’s administrative costs are not fully re-covered from developers.  However, applicants with a strong connection to Rotherham will continue to have priority to purchase First Homes when they become available.

RECORD OF OFFICER EXECUTIVE DECISION

Date of Decision:

18th August, 2025

Title:

Statutory Contaminated Land Inspection Strategy – review 2025 - 2030

Decision Maker:

(Including Job Title)

Sam Barstow, Assistant Director, Community Safety & Street Scene

Details of Specific Delegation

or

Delegation contained in the relevant Sub-Scheme of Delegation.

Delegation in the Council’s Constitution, Sub-Scheme of Delegation - Section 4C of Appendix 9: Responsibility for Functions, of the Constitution (Appendix 9 - Responsibility for Functions.pdf (rotherham.gov.uk), of the Constitution it states:

1. This officer delegation scheme sets out the executive functions delegated to officers.

8. Delegations set out in this scheme will be read in conjunction with all provisions of the Council’s Constitution, and decisions taken by officers in accordance with this scheme will be taken in accordance with all relevant rules and protocols.

Under the Sub-Scheme of Delegation - Strategic Director of Regeneration & Environment, the Strategic Director has chosen to sub-delegate some or all of those functions to officers of suitable experience and seniority in his/her own directorate or in another directorate.

At pp 3 – 8 the delegations to the Assistant Director Community Safety and Street Scene are set out. At pp51 – 61 in respect of the Environmental Protection Act 1990 and related statutory instruments, amongst others, the delegation of powers in relation to issuing of statutory documents.

Decision:

The decision is to note the Statutory Contaminated Land Inspection Strategy – review 2025 - 2030.

Reasons for the Decision:

The Council is obliged by statute to have in place a Contaminated Land Strategy. Under Part 2A of the Environmental Protection Act 1990, the Local Authority is identified as the primary regulator for dealing with land contamination problems. The Council therefore has a statutory duty to inspect its area for land contamination. The process of investigating and remediating land aims to ensure that all land in the Borough is suitable for the use it is put to and does not pose unacceptable risks to human health, the environment, controlled waters and property.

Whilst the Strategy had been reviewed in 2024, a Council Motion of 15th January 2025 required a peer review of the Strategy to be undertaken.

Delegation contained in the relevant Sub-Scheme of Delegation.

Council Constitution, Appendix 9, Section 4C2: Assistant Chief Executive – Delegated Executive Functions:

The Assistant Chief Executive is authorised to discharge executive functions in relation to:- (6) Performance, Intelligence and Improvement, including Policy and Partnerships.

The functions and delegations of the Assistant Chief Executive are currently being exercised by the Strategic Director of Finance and Customer Services. This arrangement is set out as a footnote, on the first page of Appendix 9 (Responsibility for Functions) of the Council Constitution as follows:

Further to Appendix 9, Section 3A paragraph 3(e) of the Constitution the Chief Executive has temporarily reallocated the functions and delegations of the Assistant Chief Executive to the Strategic Director of Finance and Customer Services

Decision:

To approve the undertaking of consultation to support the refresh of the Inclusion Strategy.

Reasons for the Decision:

Public consultation and engagement is essential to enable residents and stakeholders to contribute to the development of any strategy. Therefore, the undertaking of in person and online formats working in partnership with relevant stakeholders is recommended.
