Officers exercise delegated decision making powers in respect of both non-executive and executive functions of the Council.

The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

The Chief Executive and Strategic Directors of the Council have established their own sub-schemes of delegation detailing which and how both non-executive and executive functions will be discharged on behalf of the authority.

The leaseholder has contacted the Council to purchase its leasehold title from them. The acquisition of the leasehold title of this land will ensure that the design and layout of the proposed scheme will not be affected by any gaps in title.

 

The Council has agreed to pay the amount that will renumerate the leaseholder in respect of its original purchase (that was originally entered into to assist in the regeneration of this area) and its professional fees.

Option 1: Do nothing.

A ‘do nothing’ option would result in the continued fragmented ownership of the site and prevent the demolition of the block from being undertaken, thus preventing the development of the proposed comprehensive scheme that was approved by Cabinet in August 2023 and has secured the central government ‘Levelling-Up’ investment from the previous Government’s Department of Levelling Up and Communities (DLUHC). This option was discounted.

 

Option 2: Compulsory Purchase Order

It is always the council's intention to acquire by negotiation. However, in the event of no agreement of terms, the Council is currently pursuing Compulsory Purchase powers to acquire outstanding interests. Whilst this was considered, negotiations were positive, resulting in non-application of this route.

The Strategy is set to expire, necessitating a review and refresh. Under Section 1(1) of the 2002 Act, the Council is obligated to: (a) Conduct a homelessness review for their district. (b) Formulate and publish a homelessness strategy based on the review's findings.

 

Decision:

Approve the proposed one round of consultation to commence immediately, which will run for the duration of 8 weeks, which will help to facilitate the formulation of a new draft Homelessness Prevention and Rough Sleeper Strategy which is on the Forward Plan for May 2026.

 

Reasons for the Decision:

The Homelessness Code of Guidance, states that Housing authorities must consult public or local authorities, voluntary organisations, or other persons as they consider appropriate before adopting or modifying a homelessness strategy. It also states that Housing authorities may also wish to consult with service users and specialist agencies that provide support to homeless people in the district.

Best practice includes engaging with people with lived experience of homelessness. This was demonstrated in the development of the current Homelessness Prevention and Rough Sleeper Strategy 2023-2026.

Although significant progress has been achieved during the current strategy period, housing services have encountered new challenges related to the six priorities. These challenges include the continued cost-of-living crisis impacting households, a shortage of affordable housing, and changes in the private rental market.

During the current term of the Rotherham’s Homelessness Prevention and Rough Sleeper Strategy there has been a change in central government. The new government is planning to publish the updated Homelessness Strategy in mid-2025. This Strategy will likely address current challenges and outline new priorities and initiatives to tackle homelessness more effectively.

Despite the key issues noted above, Housing Services does not anticipate that the refreshed strategy will propose extensive changes to the existing strategy, given that the current strategy was approved in March 2023.

Preferred option for the following reasons:

Consultation Approach:

It is proposed to proceed with a streamlined, single-round consultation approach, considering the extensive engagement and consultation previously conducted in 2022/23 for the current Homelessness Prevention and Rough Sleeper Strategy 2023-2026.

Consultation Themes:

The consultation will focus on presenting the key aims and six priorities of the current Strategy (2023-26). The Council will seek feedback from stakeholders and residents on the following areas:

  • Whether the priorities remain relevant to Rotherham.
  • How the Council can support the achievement of these aims and priorities.
  • Any additional key homelessness issues that should be included in the next Strategy (2026-2031), which is proposed as a five-year plan to allow for a longer implementation period.

There is no legal requirement for an extensive consultation period. The Local Government Association suggests, as best practice, a consultation of 6-12 weeks.The proposed approach allows for a consultation period within this range.

The key recommendation of the report is to continue with the making of the orders for the proposal.

Reasons for the Decision:

Failure to secure the traffic regulation order may result in vehicles parking within the proposed turning head, which may affect the free and safe flow of traffic or contribute to collisions at the nearby Greasbrough Road junction due to vehicles reversing into the busy a classified road. The proposed change to the traffic regulation order addresses this.

One option considered, was having no lengths of waiting restriction or a waiting restriction that applied only at specific days and times. However, after further investigation, this option was not considered appropriate as the turning head facility should be available at all times.

Decision:

To confirm that officers carry out an operational reroute of the Waste Collection service to ensure the efficient and effective collection and disposal of Waste and Recycling.

Reasons for the Decision:

To ensure that the Council meets its legal obligations to ensure that the waste collection service is operated in an efficient and effective way.

 

Details of alternative options considered and rejected:

Considerations have included route analysis and mapping of 4 day collection routes.  After considering the implication of the 4 day options and the requirements to reroute collections and change collection days to over 85% of residents, this was discounted.

 

The focused 5-day route optimisation work has been identified as the most efficient model of refuse collection after taking into account all known route constraints and the results of the 4 day analysis.  Furthermore, the report provided by Bartec in the Autumn of 2024 demonstrated that there were no significant savings to be gained through changing to a four-day model.  The service began to develop the detailed routing required to enact the 5-day optimised model with a potential go live date of Autumn/Winter 2025. The 5-day modelling has provided opportunity to deliver savings and a figure of £500k was committed to in the 2025/26 budget.  There are also potential Carbon reductions available totalling circa ca. 80 tCO2e per annum. 

 

The recommendation therefore confirms that officers carry out an operational reroute of the Waste Collection service over 5 days to ensure the efficient and effective collection and disposal of Waste and Recycling.

Rotherham has been received the Local Stop Smoking Services and Support Grant 2024/25 of £398,587 for 2025/26. £344,845 of this has been allocated to Connect Healthcare Rotherham CIC (Connect) to continue the delivery of additional service provision relating to the Local Stop Smoking Services and Support Grant 2025/26 aims.

 

On 17 March 2025 Cabinet approved the Grant spending as part of the Confirmation of Supplementary Public Health Grants for 2025/26 paper.

 

The funding will stimulate additional quit attempts, link smokers to effective interventions, boost community stop-smoking service (CSSS) capacity, build professional competence, and strengthen partnerships within local healthcare systems.
