The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

On 2nd March 2022, Council approved the Budget and Council Tax 2022/23 and Medium Term Financial Strategy

 

As part of this a number of New Capital Proposals were included in Appendix 3B New Capital Proposals, of which one was the ‘Operational Building Decarbonisation’ Capital project.

 

This approval allowed for allocation of funding, delivery of the scheme and any associated activities, including procurement of a contractor. 

 

The schemes progress would be retrospectively reported to cabinet on an annual basis (February) as part of the Climate Emergency Annual Report. 

 

Decision:

To award the contract to William Birch Limited, for the provision of decarbonisation and energy efficiency works at the following four buildings:

Springwell Gardens, 115 Middle Lane South, Swinton Community Centre and Library and Peacock Lodge Children’s Home.

 

The value of this contract is £435,518

 

Reasons for the Decision:

This procurement was conducted in full compliance with the Council’s Financial and Procurement Procedure Rules (FPPRs), as set out in Appendix 5 of the Council’s Constitution. The process included:

 

  • Business Case Preparation: A business case was developed and options were assessed to ensure best value for money, quality, and social value, in accordance with Council policy and Section 4 of the FPPRs.
  • Competitive Procurement: A competitive procurement process was used, appropriate to the contract value, with all quotations and tenders received in writing and retained for audit purposes, as required by Sections 10 and 11 of the FPPRs.
  • Consideration of In-House Provision: In line with Section 50 of the FPPRs, in-house provision was considered, and external suppliers were used only where internal capacity was unavailable.
  • Authorisation and Oversight: Approval to award the contract was obtained in accordance with the thresholds and authorisation requirements set out in the FPPRs and Cabinet Report, with oversight from the S151 Officer and consultation with the relevant Cabinet Member (Sections 12 and 13).
  • Regulatory Compliance and Transparency: All procurement activity was conducted in accordance with UK procurement regulations and the Council’s transparency and reporting requirements (Sections 14 and 15).

 

This approach ensures that the procurement process was robust, transparent, and aligned with both statutory requirements and Council policy.

 

This decision has been made in line with the Cabinet approval to deliver a decarbonation scheme on a number of building which in turn will assist with the progress towards the Council’s Net Zero by 2030 target.

Agreement for the land swap deal is required between RMBC and the Royal Mail to facilitate the completion of the River Walk.  This will enable the walk to come out on to Main Street rather than becoming a dead end or having to divert away from the river’s edge.  It will also facilitate Royal Mails plans to introduce electric charging points for its fleet of vehicles within its compound.

 

Details of alternative options considered and rejected:

Option 1, the recommended approach, is to undertake a land swap by agreement.

 

Option 2 pursues to secure an acquisition. This option can be dismissed in favour of land swap by agreement as the Royal Mail are not interested in a land sale as require land to introduce the electric charging project.

 

A do-nothing option would see the Council unable to deliver on its ambitious plans for the regeneration of the Riverside Residential Quarter.

Reasons for the Decision:

RMBC has had 2025/26 funding to establish, mobilise and deliver a localised programme against year 1 targets for the SY Economic Inactivity Trailblazer. The programme is now approaching year 2 and DWP have funded SY to build on the foundations laid in year one, further testing against the key test and learn areas, driving innovation and system change within localities

Details of alternative options considered and rejected:

Do not continue with year 2 delivery of Pathways to Work Economic Inactivity Trailblazer - Pathways to Work is a region-wide drive for system change within the employment, skills and health landscape, with a view to simplifying the system, improving the lives of residents, strengthening communities and addressing long-standing structural economic challenges. SYMCA and the four South Yorkshire LAs need to work in partnership to achieve this. Non-participation would result in Rotherham missing an opportunity to secure resources to address what is a persistent and increasing challenge to improving economic and social inclusion. Given the high profile of the Pathways to Work Commission, and with Government funding an Economic Inactivity Trailblazer for South Yorkshire, non-participation would carry significant reputational risk.

 

A withdrawal from the PtW EIT would result in an inability to build on the strong foundation already laid, resulting in essential support being removed from Rotherham residents, negatively impacting on stability, health and wellbeing, quality of lives and local economic growth.

The preferred option is to acquire all properties by agreement,

 

Consideration has been given to entering into partnership arrangements with landowners rather than taking full control of the land. In progressing negotiations this approach will be considered on a project-by-project basis, however in many cases, and as understood through early consultation, landowners do not always wish to bring forward schemes fitting with masterplan ambitions, or development is not in the core business of the landowners.

 

Do nothing is not a recommended option, considering the Council’s ambitious plans for economic growth and regeneration in the Borough.

 

Acquisition of each property could be brought forward on an individual basis, however, considering the quantity of land and property for acquisition and the timeframe it is considered that seeking approvals on a site-by-site basis would introduce a significant risk to the programme, in terms of readiness for timely acquisitions and delivery of the programme. It is considered more appropriate and efficient to delegate acquisition as described in this report.

Cabinet approved the move to develop an Electric Vehicle Charging Project at Drummond Street on the 19th June 2023

In this meeting it was resolved:

 

  1. That Cabinet approves the £1.29m funding into the Capital Programme for the delivery of the Electric Vehicle Charging Project at Drummond Street Car Park, subject to planning approval; and

 

  1. That Cabinet approves the procurement of a concession contract to design, install and operate the Electric Vehicle Charging systems.

 

This decision therefore relates to the conclusion of this procurement and its subsequent award.

 

This procurement was conducted in full compliance with the Council’s Financial and Procurement Procedure Rules (FPPRs), as set out in Appendix 5 of the Council’s Constitution. The process included:

 

  • Business Case Preparation: A business case was developed and options were assessed to ensure best value for money, quality, and social value, in accordance with Council policy and Section 4 of the FPPRs.
  • Competitive Procurement: A competitive procurement process was used, appropriate to the contract value, with all quotations and tenders received in writing and retained for audit purposes, as required by Sections 10 and 11 of the FPPRs.
  • Consideration of In-House Provision: In line with Section 50 of the FPPRs, in-house provision was considered, and external suppliers were used only where internal capacity was unavailable.
  • Authorisation and Oversight: Approval to award the contract was obtained in accordance with the thresholds and authorisation requirements set out in the FPPRs and Cabinet Report, with oversight from the S151 Officer and consultation with the relevant Cabinet Member (Sections 12 and 13).
  • Regulatory Compliance and Transparency: All procurement activity was conducted in accordance with UK procurement regulations and the Council’s transparency and reporting requirements (Sections 14 and 15).

 

This approach ensures that the procurement process was robust, transparent, and aligned with both statutory requirements and Council policy.

 

The implementation of the Solar Canopy and EV Charging will enable reducing carbon emissions emitted and supporting a local transition to electric vehicles through the provision of destination and residential charging in the town centre.
