Officer Decisions

Officers exercise delegated decision making powers in respect of both non-executive and executive functions of the Council.

The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

The Chief Executive and Strategic Directors of the Council have established their own sub-schemes of delegation detailing which and how both non-executive and executive functions will be discharged on behalf of the authority.

Decision records for the discharge of functions by officers are published below. These decision records set out the following information:-

03/06/2025 - Decision to vary the 0-19s Integrated Public Health Nursing Service (IPHNS) with the Rotherham NHS Foundation Trust (TRFT) for the provision of Family Hub activity ref: 1942    Recommendations Approved

The decision is to vary the 0-19 Integrated Public Health Nursing Service (IPHNS) with TRFT by contract variation of £327,067 to deliver activities using the Family Hubs Grant for 12 months.  This period will commence from 1 April 2025 and expire the 31 March 2026.

3 June 2025

Title:

Officer Decision Record for the award of the contract variation to the 0-19s Integrated Public Health Nursing Service (IPHNS) with The Rotherham NHS Foundation Trust (TRFT) for the provision of Family Hub activity.

Decision Maker:

(Including Job Title)

Ian Spicer, Strategic Director for Adult Care, Housing and Public Health.

Details of Specific Delegation

or

Delegation contained in the relevant Sub-Scheme of Delegation.

Under Section 4C3 of the Responsibilities for Functions document (App 9 of the Constitution) the Strategic Director of Adult Care, Housing and Public Health is authorised to discharge executive functions through the commissioning and provision of social services for adults and public health services for the whole population and delivery of housing for the Borough, including: -

3. Public Health (a) Commissioning and Quality (b) Health Improvement (c) Health Intelligence (d) Health Protection

Decision:

To undertake a contract variation for the 0-19 Integrated Public Health Nursing Service with The Rotherham NHS Foundation Trust.

Reasons for the Decision:

Rotherham has been awarded the Family Hubs and Start for Life Grant. The Grant was made available to Rotherham Metropolitan Borough Council by the Department of Education (DfE) and the Department for Health and Social Care (DHSC) as one of the 75 Local Authorities that were selected.

On 13 February 2023 Cabinet accepted the Grant funding and approved the approach to the governance and management of the Grant.

It is to be directly awarded to The Rotherham NHS Foundation Trust as Health Visitors are already delivering the activities above as part of the current contract on a targeted basis, and therefore, the universal provision can only be delivered by the Service.

Details of Specific Delegation

or

Delegation contained in the relevant Sub-Scheme of Delegation.

On Monday 14th February 2022, Cabinet gave authorisation of a Capital budget to identify and deliver a number of decarbonisation schemes to be funded through this budget and/or through external funding, where available.

Agenda for Cabinet on Monday 14 February 2022, 10.00 a.m. - Rotherham Council Item 107 Budget and Council Tax 2022/23 and Medium term Financial Strategy. Approved recommendation 11 of the Capital programme detailed in Appendix 3B ‘Operational Building Decarbonisation’ Capital project.

Printed minutes Monday 14-Feb-2022 10.00 Cabinet.pdf

Minute 107 refers.

‘Resolved:- That Cabinet recommend to Council: 1. Approval of the Budget and Financial Strategy for 2022/23 as set out in the report and appendices, including the proposed budget adjustments and investments, a basic Council Tax increase of 1.5% and an Adult Social Care precept of 3%.’’

The schemes would be retrospectively reported to cabinet on an annual basis (February) as part of the Climate Emergency Annual Report.

Decision:

The decision has been taken to utilise £350,000 of the Council’s capital decarbonisation budget to maximise the solar PV on the town centre markets and library rooftops.

Reasons for the Decision:

In February 2022, Cabinet approved a budget to support the decarbonisation of the Council’s corporate estate.

An opportunity has arisen to enhance the solar photovoltaics (PV) already included within the Markets and Library projects. As the site is to be electrically heated as per planning requirements, further solar PV will reduce the ongoing revenue requirements for the site following completion and avoid the need for retrofit at a later date to meet the Council’s decarbonisation targets. Maximising on site renewable generation will also improve the sites operational carbon footprint.

Details of alternative options considered and rejected:

The Council has also considered retrofit of the site with solar panels after the completion of the current construction scheme. However, due to the Council’s 2030 target and the timeframe for decarbonisation being short a later retrofit may also void any roofing warranties applied and potentially interrupt service delivery. Installation as part of the existing project and contract is therefore preferred.

Doing nothing was also considered, but this would lead to increased revenue costs to the Council and would not ensure a decarbonised estate.

Eastwood Sites Housing Development

1.     That Cabinet approve development of the Netherfield Court and York Road sites in Eastwood to build a projected 31 new homes for Council rent.

2.     That Cabinet delegate authority to the Assistant Director of Housing in consultation with the Cabinet Member for Housing to make amendments to the scheme design, where this is necessary to comply with planning and other statutory consultee requirements, or where site conditions prescribe a design alteration.

Decision

Award contract to G.S Kelsey under a Pre-Construction Service Agreement (PCSA) for the development of Council-owned land at Netherfield Court and York Road, Eastwood, which forms part of the Housing Delivery Programme.

Reasons for the Decision:

This scheme forms part of a broader package of sites being brought to market.

An outcome of this process is to recommend award of a Pre-Construction Services Agreement through the Efficiency North (EN: Procure) New Build framework. Utilising Efficiency North’s Framework Capability Criteria, G.S. Kelsey are the highest ranked contractor with capacity to undertake the proposed works in the geographical area.

Details of alternative options considered and rejected:

Option Rejected: Not developing the sites for new council homes. This would leave the sites vacant or dispose of them through asset sales, which is not recommended due to the acute need for larger family accommodation in the Eastwood Village area.

Decision taken under the powers granted to the property officer under section 29.12 of the Council’s Financial Procurement Procedure Rules.

Paragraph 29.12.1 states where the estimated disposal value is less than £100,000 the Property Officer, having taken financial and legal advice, may arrange for the disposal of land or property.

Decision:

That the Assistant Director for Property & Facilities Services approves the disposal by agreement of the freehold interest of 1o8 Psalters Lane, Kimberworth in consultation with the Council’s Section 151 Officer and the Cabinet Member for Transport, Jobs, and the Local Economy

Reasons for the Decision:

Under the Leasehold Reform Act 1967, a leasehold property owner has the statutory right to either extend the length of their existing lease or to purchase the freehold title to their property.

Given the direct approach from the leaseholder, the only option is to dispose of the freehold interest in the property. The long leaseholder in this instance is exercising their statutory right to purchase the freehold.

Approval is sought to dispose of the freehold interest in 108 Psalters Lane, Kimberworth for £1,450 plus a contribution towards the Councils professional fees.
