The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

An outcome of this process is to recommend direct award of a Pre-Contract Services Agreement through the Efficiency North (EN: Procure) New Build framework. Utilising Efficiency North’s Framework Capability Criteria, GS Kelsey are the highest ranked contractor with capacity to undertake the proposed works in our geographical area. |

Various design options for the structural solution of Packman Road have been considered and costed through the design stages. The recommendation is that a do minimum repair will not provide a suitable repair and significant residual risk will be present. Therefore, the option of a comprehensive repair is the viable and recommended option. Do nothing is not an option given the proximity of properties, important classified road and public interest.
Alternative routes to market were considered as part of the Procurement Business Case submission. The other options were discounted due to the expected time-consuming nature of the evaluation process, the potential delays in awarding the contract, their suitability in terms of cost-effectiveness and availability of expertise.

Brief Description of Decision: |
The South Yorkshire Mayoral Combined Authority (SYMCA) have allocated £3m revenue to Rotherham Metropolitan Borough Council as a ‘Feasibility Fund’. A grant agreement has been signed to accept the funding and the decision is to allocate £600,000 of the Feasibility Fund to support the redevelopment of Strategic Sites in the town centre.

Reasons for the Decision: |
Allocation of £600,000 to accelerate the first stages of planning and feasibility for a programme of interventions which seeks to secure a future for these sites and meet the Council’s long-standing aims for regeneration of the town centre as a vibrant and successful place. |
Details of alternative options considered and rejected: |
The Feasibility Fund is specifically allocated for the progression of Rotherham’s PBIS and the projects and ambitions described above are part of this strategy. The feasibility Fund is therefore considered the best source for this proposal.

Brief Description of Decision: |
The South Yorkshire Mayoral Combined Authority (SYMCA) have allocated £3m revenue to Rotherham Metropolitan Borough Council as a ‘Feasibility Fund’. A grant agreement has been signed to accept the funding and the decision is to allocate £38,000 of this fund.
The allocation will be used to appoint a team of consultants to develop an appropriate and ambitious concept for the new market and food hall.

Details of alternative options considered and rejected: |
The rationale in going direct award was to enter into a Professional Service Agreement with a Contractor to complete the Stage 4 design with a view to speeding up the delivery time and obtaining cost certainty. This was deemed essential given the timescales that we had to achieve and limitations on budget.
Other options considered include.
Above Threshold Open Procedure - Maximise access to the supply market however this would potentially yield a significant volume of bids that would disproportionally extend the timeframe, making it potentially difficult to meet the timescales required for this project.
Further competition under the CCS Framework RM6088 (Construction Works & Associated Services) - Lot 2.1 Construction Works & Associated Services (£3m - £10m) - The sub-regional arrangements and value in this framework would suit RMBC’s requirements however there are no local suppliers on this framework at all and many major contractors would not be interested in this low value construction project.

Reasons for the Decision: |
This scheme forms part of a broader package of sites being brought to market. Significant work has taken place to review each in detail, and carefully consider, the correct strategy for the scheme. Various iterations of the planned route to market and packaging of sites to attract the right bidders and provide value for money have been discussed over the last 12 months.
An outcome of this process determined that a single stage design and build competition utilising Construction Line was the most suitable option for delivery of this scheme. Following a competitive tender process, it was recommended to award a construction contract to R.H. Fullwood who were the highest scorers. |
