Officer Decisions

Officers exercise delegated decision making powers in respect of both non-executive and executive functions of the Council.

The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

The Chief Executive and Strategic Directors of the Council have established their own sub-schemes of delegation detailing which and how both non-executive and executive functions will be discharged on behalf of the authority.

Decision:

To direct award to R H Fulwoods under a Pre-Construction Services Agreement (PCSA) in relation to the development of the Occupation Road , Broom, which form part of the Housing Delivery Programme.

 

Reasons for the Decision:

This scheme forms part of a broader package of sites being brought to market.

 

An outcome of this process is to recommend direct award of a Pre-Construction Services Agreement through the Efficiency North (EN: Procure) New Build framework. Utilising Efficiency North’s Framework Capability Criteria, R H Fullwoods are the highest ranked contractor with capacity to undertake the proposed works in the geographical area.

A broad range of procurement routes and methods, including alternative frameworks and competitive tenders were extensively considered as part of determining the procurement strategy.

The Cabinet resolution October 2024 (minute 63), amongst other things, delegated to the Council’s Property Officer, in consultation with the Cabinet Member for Jobs and the Local Economy and the Assistant Director of Legal Services, to:

a)    Take all necessary steps to secure the making, confirmation and implementation of the CPO, including, making further amendments by way of finalising the draft Statement of Reason (Appendix 3) the publication and service of all relevant notices and the presentation of the Council’s case at any future local public inquiry;

b)    Consider the outcome of the Equalities Impact Assessment and ensure appropriate steps are taken to meet the Council’s Public Sector Equalities Duty.

Having consulted with the Cabinet Member for Jobs and the Local Economy, the Assistant Director of Legal Services, and the Council’s Property Officer makes the following decision for reasons set out in the report:

a)    having considered the outcome of the Equalities Impact Assessment in accordance with the Council’s obligations pursuant to the Equality Act 2015 is satisfied that the Council has taken into account and paid due regard to the aims and objectives of its public sector equality duty and has considered what actions it will take to mitigate any negative impacts on particular protected groups as set out below.   

b)    In light of the decision in 1 above, and having now finalised the form and content of the Statement of Reasons, to approve the making of the CPO taking all steps necessary, to secure the confirmation of the CPO

Decision:

Implementation of the Cabinet resolution in October 2024 to make and seek confirmation of a Compulsory Purchase Order (CPO) for the acquisition of land and property interests identified on the plan and in the schedule in Appendix 1 and 2.

Reasons for the Decision:

To enable the purchase of all property required to facilitate the implementation of the Council’s Dinnington Regeneration project which will see improvements to the high street including a new market provision, 6 new retail units, refurbished units and public realm fronting Laughton Road.

Details of alternative options considered and rejected:

Cabinet resolved in October 2024 to pursue the recommended option as follows:

“Acquire the outstanding interests by CPO and develop the approved scheme.”

This option was considered to provide the greatest degree of certainty that the scheme can be delivered by the Council.

Other options considered can be seen in detail in the October 2024 Cabinet report and are listed below:

·       Option 1: Do Nothing

·       Option 2: Deliver a smaller scheme based on the Council’s current ownership.

·       Option 3: Focus entirely on acquiring the Order Land by negotiation and redevelop it for the proposed Scheme.

“The discharge of any executive function not otherwise reserved to the full Council, the Cabinet, a committee of the Cabinet, a member of the Cabinet, a joint committee discharging executive functions or another local authority, and any non-executive functions not otherwise reserved to the Licensing Board, or any other person or body discharging non-executive functions in accordance with executive arrangements made by the Council, in respect of the legislation listed below (including and any future modifications, enlargements or amendments).”

 

The House to House Collections Act 1939 is listed in this section.

 

Brief Description of Decision:

1.    That the findings of the officer review of the House to House Collection Policy are noted.

 

2.    That the House to House Collection Policy is further reviewed in December 2029.

Reasons for the Decision:

The review has confirmed that the current House to House Policy is effectively delivering its aims and objectives, and therefore further revision is currently unnecessary.  This position will be reassessed during the next formal review which is scheduled to take place in December 2029.

 

Details of alternative options considered and rejected:

1.    The current policy could be disregarded and the Council would instead rely on the statutory text.

 

This option was rejected as it would limit the clarity of the process and Council expectations, including the value of collections that is returned to charities, and the times at which collections might be considered to be unreasonable.

 

2.    A full formal review of the policy could be carried out prior to the scheduled 2029 review.

 

This option was rejected as it would be unlikely to result in any amendments to the policy, as the findings of the consultation carried out in 2023 have been incorporated into the current policy and feedback from applicants, officers and members of Licensing Board is that the current policy is delivering its aims and objectives and therefore a further review is unnecessary.
