The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.
The Chief Executive and Strategic Directors of the Council have established their own sub-schemes of delegation detailing which and how both non-executive and executive functions will be discharged on behalf of the authority.

Reasons for the Decision: |
The Council is working with partners to promote the development of Rotherham Gateway Station. To ensure this opportunity brings the greatest benefit to Rotherham communities, the Council undertook the development of a Masterplan, exploring how development in the vicinity of the station could contribute to wider regeneration and growth objectives across the Borough and act as a catalyst for investment. This decision seeks delegated approval to prepare and submit a Programme Business Case for the Masterplan to SYMCA to explore routes to funding the scheme. |

Details of alternative options considered and rejected: |
The Council could prepare individual business cases for each project within the scheme rather than submitting a whole strategic programme business case. This would create a piecemeal approach that would not capitalise on the opportunity for a wider ‘place-based’ investment that could transform the area. It could also lead to delays to the scheme coming forward due to dependence on different timelines for different funding streams. This option is not recommended.
The Council could choose to not submit a Strategic Programme Business Case to SYMCA at this time; however, this could result in a missed opportunity to work with SYMCA as part of the wider Don Valley Growth Corridor development.
This option is not recommended.
By submitting the Strategic Programme Business Case now and continuing the discussions with SYMCA around the ‘place-based’ approach, the Council can maximise the benefits the Masterplan offers and ensure the design work can be integrated with the Mainline/tram-train design, taking place as part of the Full Business Case. This option is recommended. |

Option 1 - Do nothing This work could not be taken forward at this time, seeing the property remain in private sector ownership. The Council has acquired significant land and property within this area of the town, the proposition for the market and impact on the town centre of a larger development site is considered more beneficial.
If the Council were to pursue acquisition at a later date, it would necessitate a Compulsory Purchase Order (CPO) process—incurring significant additional costs in time, resources, and public funds, while also introducing legal complexity and potential delays that could jeopardise the momentum and credibility of the wider regeneration programme. However, the capital funding allocated and the acquisition of this and a number of key town centre sites over the last two years has been for the specific purpose of regeneration and the achievement of Rotherham’s ambitions. With the availability of Strategic Acquisition fund and the £600k allocated Feasibility Funding for the strategic sites work, alongside Rotherham town centre’s ongoing regeneration, it is now considered to be the right time to undertake this work.
Option 2: Acquisition by Negotiation The Council will always seek to acquire properties by negotiation. Terms have now been agreed between the parties which will allow the scheme to progress. This option is therefore recommended.
