Officer Decisions

Officers exercise delegated decision making powers in respect of both non-executive and executive functions of the Council.

The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

The Chief Executive and Strategic Directors of the Council have established their own sub-schemes of delegation detailing which and how both non-executive and executive functions will be discharged on behalf of the authority.

1.     Approval to enter into contract with RH Fulwoods to construct 10 new homes in East Herringthorpe.

The East Herringthorpe scheme forms part of the Housing Delivery Programme and was first approved by Cabinet via the September 2020 Cabinet report: Annual Housing Development Report – 2020/21.

 

Cabinet approvals have been reaffirmed in further programme reports, with the latest iteration of the programme being approved by Cabinet January 2023: Housing Development Programme Report – 2023/24.

 

The scheme will deliver 10 new homes which will be brought into the Council’s housing stock and made available for rent to applicants on the housing register. It will comprise:

·       3nr 1-bed houses

·       4nr 2-bed houses

·       2nr 2-bed bungalows

·       1nr 4-bed specialised bungalow (also referred to as a wheelchair user dwelling)

The Cabinet, 21 September 2020, minute 52(1):

 

That Cabinet approves the release of the Council owned sites listed in Appendix 3a for early residential development, subject to development being undertaken directly for council stock with the Council retaining ownership of the land and homes, or by a registered social landlord with the Council retaining tenancy nomination rights where this is deemed to offer better value, and subject to written confirmation of agreement by the relevant Ward Members.

 

The September 2020 report marked the launch of an annual programme reporting cycling, with the latest iteration of the programme having been most recently considered by Cabinet January 2023.

 

The Cabinet, 23 January 2023, minute 104(1):

 

That Cabinet approved the Council-owned sites listed in Appendix 3 being brought forward to deliver new Council homes.

 

and further to approval of the subsequent Full Business Case – East Herringthorpe Small Sites Cluster Housing Development, approved 2 June 2023 in consultation with the Cabinet Member for Housing.

 

Decision:

Reasons for the Decision:

The decision has been taken in-line with the Cabinet approval, to ensure that the Council can continue to deliver new council homes to meet residents’ needs.

 

Right to Buy ‘1-4-1’ receipts will form the main subsidy contribution toward this scheme because:

a)    The homes are high specification and there is an acute viability gap which will be best met through the inclusion of RTB 1-4-1 receipts which can contribute up to 40% of the cost

b)    RTB 1-4-1 receipts are timebound, meaning they have to be deployed within a set timeframe otherwise they are repaid to government

c)    The government has recently introduced a cap on the number of acquisitions which can be funded with RTB 1-4-1 receipts, meaning that more receipts need to be deployed into Council build schemes

 

Social Rents are lower than Affordable Rents and it is the Council’s strategic preference to make council homes as affordable for our residents as possible, meaning that the homes are to be let on Social Rents rather than Affordable Rents. Whilst this impacts upon scheme viability, it is considered that this approach can be supported for this scheme, within the context of the longer-term Housing Revenue Account (HRA) Business Plan.

 

Details of alternative options considered and rejected:

The September 2020 Cabinet report considered a number of alternative options, including not to bring forward any new proposed housing development schemes. This was not recommended because it would not achieve any of the benefits provided by supporting housing growth, would make it significantly more difficult for the Council to achieve its corporate and national targets and means that there would be no mitigation against Council’s social housing stock being lost as a result of the Right to Buy.

Brief Description of Decision:

 

To set Affordable Rents for council properties for the purpose of lettings to new tenants at the same value as Affordable rents charged to existing tenants for 2023/24.  This is a 7% increase against the 2022/23 Affordable rent value and therefore the same as the increase for social rents (subject to a separate Council decision).

Reasons for the Decision:

 

 

Government Legislation dictates that Affordable rents must be re-assessed every time that an Affordable rent property is re-let to a new tenant to ensure that the Affordable rent remains no higher than 80% of the market rent for a similar property in that location. 

At the Council meeting on 22 January 2020 it was agreed that this would be achieved by undertaking an assessment of all Affordable rent properties bi-annually, rather than having individual valuations each time the property became vacant.  Agenda item 12, Recommendation 4:

That all Affordable Rent properties be revalued in October and March each year to provide a valid rent value for when Affordable Rent properties are relet.

To meet this requirement a desktop exercise is undertaken in March and October each year to review whether the current Affordable rent value charged to existing tenants for each property remains within 80% of the market rent for similar properties in the Borough.

The exercise in February 2023 has concluded that based on market rent average values on Hometrack for Rotherham the actual current Affordable rents for 2023/24 are within 80% of market rent values and will be used as the re-let value for these properties.

Details of alternative options considered and rejected:

Increase affordable rents for re-let properties by CPI+1% to match the normal approach taken for formula rent. This would result in an 11.1% increase.  This is not recommended as it would result in the rents for some properties on re-let being higher than 80% of Market rents.  This would not meet Government policy for Affordable rent values at re-let.

Reasons for the Decision:

 

 

The grant acceptance and associated activities were agreed in the Cabinet paper of July 2022. Due to the ongoing tender process, it was not possible to specify the service provider in the Cabinet paper and as such Cabinet did not formally approve this variation to the provider contract.

 

The commissioned drug & alcohol treatment provider, CGL (up to the 31st March 2023, when the contract ends), continued to provide activities and staff posts which commenced under the previous PHE Universal Grant. Procurement confirmed that there remained enough flexibility in the contract terms to allow for this additional funding to be awarded to CGL for the specified period.

This proposal was approved by Public Health Senior Management Team on the 28th September 2022, and by Adult Care, Housing & Public Health Directorate Leadership Team on the 4th October 2022.

Reasons for the Decision:

Following evaluation of the procurement options against the Council’s requirements, the Council used the Kent Commercial Services (KCS) Software Products & Associated Services 2 Framework (Y20011) to undertake this procurement exercise, in accordance with the Council’s FPPR’s. This framework allows for a direct award.

 

Details of alternative options considered and rejected:

The following procurement options were appraised as set-out in the procurement business case and rejected for the given reasons:

·     Above Threshold – Open Tender Process – There is a need to act quickly to enable continuation of licensing as soon as possible.  As the potential value of the contract is above the threshold set out in the Procurement Contract Regulations (£189,330 (net of VAT)), the timescales associated with undertaking this type of procedure are too long and as such this option was discounted.

·     Above Threshold – Restricted Tender Process – There is a need to act quickly to enable continuation of licensing as soon as possible.  As the potential value of the contract is above the threshold set out in the Procurement Contract Regulations (£189,330 (net of VAT)), the timescales associated with undertaking this type of procedure are too long and as such this option was discounted.

·     Direct award – Health trust Europe (HtE) Information Communication Technology (ICT) Solutions Framework (ComIT2 – CompleteIT). The Council are not able to make a clear direct award on this framework.

·     Further Competition – Kent County Council via KCS Procurement Services Software Products & Associated Services 2 Framework (Y20011). The Council are able to make a compliant direct award via the same external framework in the timeframe required, therefore this option was discounted.

·     Further Competition (Price & Quality) – Crown Commercial Services (CCS) Technology Products & Associated Services Framework (RM6068). The Council are able to make a compliant direct award via another external framework namely Software Products & Associated Services 2 Framework (Y20011) tendered and managed by Kent County Council via KCS Procurement Services, in the timescale required, therefore, this option was discounted.

·     Simplified Further Competition (Price Only) – Crown Commercial Services (CCS) Technology Products & Associated Services Framework (RM6068). The Council cannot seek social value offers on this procurement route.  This option was discounted.

·     Further Competition – Yorkshire Purchasing Organisation (YPO) Technology Hardware, Software and Services Framework (979). The Council are able to make a compliant direct award via another external framework namely Software Products & Associated Services 2 Framework (Y20011) tendered and managed by Kent County Council via KCS Procurement Services, in the timescale required, therefore, this option was discounted.

·     Price on Demand – Yorkshire Purchasing Organisation (YPO) Technology Hardware, Software and Services Framework (979). The Council cannot seek social value offers on this procurement route. 

·     Direct Award – Crown Commercial Services (CCS) G-Cloud 13 Framework (RM1557.13). The Council cannot make a clear direct award on this framework to one (1) Supplier.

On 24th April 2023 Cabinet agreed the following recommendations:

 

That the Assistant Director for Planning, Regeneration and Transport be authorised to negotiate the acquisition by agreement of the property interests at exempt Appendix 1, in consultation with the Council’s Section 151 Officer and the Cabinet Member for Jobs and the Local Economy, and the Assistant Director of Legal Services be authorised to complete the necessary transactions

 

An agreement to acquire property at Effingham Street has now been reached and this report will exercise the delegation to agree Heads of Terms and complete the land transaction.

Brief Description of Decision:

Completion of the necessary transactions to acquire property at Effingham St

Reasons for the Decision:

To facilitate the continued development of regeneration in Rotherham town centre it is necessary to bring privately owned land into public sector ownership.

 

Agreement has now been reached with the private sector owner of the relevant land, and this delegation seeks to finalise the necessary transactions.

Details of alternative options considered and rejected:

The preferred option is to always acquire by agreement and negotiation is a mandatory precursor to any CPO action. This acquisition will enable land to come forward without the need to use CPO powers, thus significantly reducing the risk of needing to implement CPO powers.

Reasons for the Decision:

On the 29th of December 2019, Cabinet agreed the implementation of 25 Ward Housing Hubs with an annual Ward Housing Hub budget allocation per Ward. The annual budgets commenced from 2020/21 financial year, to be managed within a four-year cycle, with any uncommitted budget rolling forward to the following financial year, with all budgets to be spent by the end of 2023/24.

 

Cabinet authorised that the Assistant Director of Housing in consultation with the Head of Finance (Adults, Public Health and Housing), to increase the Ward Housing Hubs budget (on a ward-by-ward basis) by the value of the Ward Housing Hub underspend in the preceding year within the 4-year cycle.

 

Having received details of the value of uncommitted budget, ward by ward, as at the end of financial year 2022/23, in consultation and agreement with Corporate Finance, the decision has been made by the Assistant Director of Housing to increase the Ward Housing Hub budget by this amount in 2023/24.

Item 27 – ‘Resolved:- That Cabinet approves the Neighbourhood Road Safety Schemes listed in Appendix 2 for delivery in 2021-22 and delegates the decision on any necessary changes to the programme to the Strategic Director for Regeneration and Environment in consultation with the Cabinet Member for Transport and Environment’.

The sub-scheme of delegation authorises the Assistant Director to promote, consider objections to and implement Traffic Regulation Orders under the Road Traffic Regulation Act 1984.

Decision:

Approval of the proposal to reduce the speed limit at Ravenfield Lane to 40 mph.

 

Reasons for the Decision:

To enable the implementation of a 40mph speed limit on Ravenfield Lane between Thrybergh Lane and the A630 Doncaster Road. To assist in the reduction the incidence of injury & non injury road traffic collisions taking place.

 

Details of alternative options considered and rejected:

A 50mph speed limit was originally considered but when compared with the 40mph speed limit proposed, using the DfT speed limit assessment tool, it did not achieve the desired reductions, in casualty/injury severity & speed.
