Officer Decisions

Officers exercise delegated decision making powers in respect of both non-executive and executive functions of the Council.

The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

The Chief Executive and Strategic Directors of the Council have established their own sub-schemes of delegation detailing which and how both non-executive and executive functions will be discharged on behalf of the authority.

Brief Description of Decision:

In accordance with section 23(6) Local Government Act 2003 the Council consent to making of regulations that extend the existing borrowing powers of the South Yorkshire Mayoral Combined Authority to include all its functions.

Reasons for the Decision:

At present the South Yorkshire Mayoral Combined Authority (“SYMCA”) has borrowing powers limited to its transport functions. Under the Local Government Act 2003 these powers can be extended by regulation to include any function of an MCA. The making of such a regulation requires the consent of the constituent members of the MCA.

Regulations extending the borrowing power are only made if the relevant MCA has agreed a debt cap with HM Treasury. This has been agreed with HM Treasury and was approved by the SYMCA at its meeting in November 2021. This cap must be agreed annually with Treasury and is a central government control on borrowing by MCAs.

The extension of the SYMCA’s borrowing powers will allow the region to maximise the benefit of the annual devolution funding provided to the MCA by providing flexibility as to how this is deployed. The extension of the borrowing powers and agreement of the debt cap does not mean that the MCA will take on additional borrowing and any investment decisions would be taken at the SYMCA Board.

The Department for Levelling Up, Housing and Communities requires all constituent councils within the Metropolitan Combined Authority area to agree to such a proposal and has asked for a response by 20th January 2022.

The only other option is to object to the extension of the powers. This would prevent the scheme from progressing and limit the options of the STMCA for the future. For this reason, this option was rejected.

To step down the provision of the eight respite beds at Conway Crescent, enabling the resource to deliver hospital surge beds on a temporary basis to support patient flow at TRFT. 

 

Reasons for the Decision:

 

 

The current high numbers of Covid positive cases and outbreaks in Rotherham due to the Omicron variant is impacting on capacity at TRFT and resources for discharge, with a number of providers of intermediate care and nursing care across the borough currently closed to admissions.

 

Adult care provider services deliver 15 intermediate care beds and in the short term an additional 15 hospital surge beds.

 

Our facilities are either closed to admissions due to outbreaks or taking reduced numbers of admissions due to reduced staffing capacity.

 

The decision was made to utilise Conway Crescent for surge provision to ensure delivery of this critical need, supporting patient flow and discharge across Place.

 

The situation is being monitored and reviewed on a daily basis and Conway will revert back to business as usual as soon as the requirement for additional surge capacity reduces.

 

Any families who have had respite cancelled and are in need of alternative support during this short period will be referred to the My Front Door Team.

No current alternative options were able to be considered due to overall staffing capacity being adversely impacted by the spread of the Omicron variant.
