Councillor Austen declared a personal interest in application RB2007/1738 (retrospective application for the formation of spoil mound at Aston ComprehensiveSchool, Aughton Road, Swallownest for D.C. Leisure Management Ltd.) on the grounds that she was a member of Aston-cum-Aughton Parish Council.

 

Councillor McMahon declared a personal interest in application RB2008/1806 (erection of 8 No. three storey and 1 No. two storey office buildings with associated car parking, landscaping and drainage at land off Rotherham Road, Maltby for Boulby Davison Developments) on the grounds that he was a member of Maltby Town Council.

 

Councillor Turner declared a personal and prejudicial interest in application RB2009/0112 (conversion of bungalow to two storey dwelling house including rear extension and attached garage to side at 180 Wickersley Road, Broom) on the grounds that his brother was a next but one neighbour.

Before the formal meeting of the Planning Board, Members of the Board made visits of inspection (Ward Representative St. John was present) to the sites of the following applications and the decisions recorded were set out below:-

 

(a)  Temporary siting of mobile home for use as agricultural workers dwelling in connection with pullet rearing business at Woodsetts Poultry Farm, Owday Lane, Woodsetts for W. Potter & Sons (Holdings) Ltd. (RB2008/1254) 

 

In accordance with the right to speak procedures, the following people attended the meeting and spoke about the application:-

Resolved:- That planning permission be granted for the reasons adopted by Members at the meeting and appended to the minutes and subject to the following conditions:-

 

1.   This permission shall be valid for a period of three years only and at the end of that period (unless further permission be granted by the Local Planning Authority prior to the end of that period) or earlier if the agricultural use of the site for pullet rearing ceases, the building shall be wholly removed and the site restored in a manner to be agreed with the Local Planning Authority.

 

2.   The occupation of the mobile home shall be limited to a person carrying out operations on the farm for pullet rearing and a widow or widower of such a person and to any resident dependents.

 

3.   Details of the proposed means of disposal of foul and surface water drainage, including details of any off-site work, shall be submitted to, and approved by, the Local Planning Authority and the development shall not be brought into use until such approved details are implemented.

 

4.   Notwithstanding the approved plans, prior to the commencement of development a plan shall be submitted to, and approved in writing by, the Local Planning Authority showing a visibility splay of 2.4 m x 215 m on Owday Lane.  The development shall proceed in accordance with the approved details with this level of visibility being maintained throughout the lifetime of the development.

 

5.   Before the development is brought into use, that part of the site to be used by vehicles shall be constructed with either:-

 

(a)     a permeable surface and associated water retention/collection drainage, or;

(b)     an impermeable surface with water collected and taken to a separately constructed water retention/discharge system within the site, the area shall thereafter be maintained in a working condition.

 

6.   No development shall take place until there has been submitted to, and approved in writing by, the Local Planning Authority a plan indicating the positions, design, materials and type of boundary treatment to be erected. The boundary treatment shall be completed before the development is brought into use.

 

Reasons:-

 

1.   In order to assess the viability of the agricultural use of the site and the effect of the development on the area and in accordance with UDP Policies ENV1 ‘Green Belts’ and ENV3.1 ‘Development and the Environment’.

Resolved:- (1) That, on the development proposals now considered, decisions be recorded as set out in the schedule now submitted and the requisite notices be issued (a copy of this schedule, together with the schedule of decisions made under delegated powers, will be made available when the printed minutes are produced).

 

(2) That the time limits specified in Sections 91 and 92 of the Town and Country Planning Act 1990 apply to the decisions referred to at (1) above.

(3)  That application RB2002/1292 be refused for the reasons listed in the report  and subject to an amendment to reason No. 3 to now read “Insufficient information has been submitted to assess the impact on the future prospects of existing protected trees within the site and the potential loss would have a materially adverse effect on the visual amenities and character of the Conservation Area in conflict with Policies ENV 3.4 Trees Woodlands and Hedgerows, and ENV 2.11 Development in Conservation Areas.”

 

(4)  That applications RB2007/1738, RB2007/2078, RB2008/1857, RB2008/1897, RB2008/1898, RB2008/1918, RB2009/0104 and RB2009/0121 be granted for the reasons adopted by Members at the meeting and appended to the minutes and subject to the relevant conditions listed in the report.

 

(5)  That application RB2008/1806 be refused for the reasons listed in the report and subject to an additional reason relating to the close proximity of the three storey building and the impact it had on the appearance and character of open Green Belt land adjacent to the site, by virtue of its height and siting. 

 

(6)  That application RB2008/1896 be granted for the reasons adopted by Members at the meeting and appended to the minutes and subject to the relevant conditions listed in the report, in addition to an accompanying letter relating to the stone wall boundary treatment and the use of the stone from the existing property to be demolished on site.

 

(7)  That application RB2009/0136 be refused for the reasons listed in the report.

Discharge of Planning Condition 14, External Materials and Solar Panels for Planning Application RB2008/1129, Erection of 4 No. three storey apartment blocks (24 apartments in total) and 10 No. two storey dwellinghouses at Wagon Road, Greasbrough (RB2008/1129) pdf icon PDF 276 KB

Consideration was given to a report by the Director of Planning and Regeneration Service, which detailed the above application for approval of the external materials and proposed solar panels for the above development.

 

In accordance with the right to speak procedures, Mr. Cartwright (on behalf of the Applicant) attended the meeting and spoke about this application.

 

Resolved:-  That the submitted sample materials be approved.

190.

Outline application for the demolition of the existing building and erection of ground floor café and retail units with residential above and basement parking including details of access at The Grand Cinema, Muglet Lane, Maltby for Mr. Scott Blount (RB2009/0020)

Minutes:

Consideration was given to a report by the Director of Planning and Regeneration Service, which detailed the above application for outline planning permission.

 

In accordance with the right to speak procedure, Mr. S. Blount (Applicant) attended the meeting and spoke about this application.

 

Resolved:- (1) That the Council enter into an agreement with the developer under Section 106 of the Town and Country Planning Act 1990 for the purposes of ensuring provision of affordable units.  The affordable units to be provided by the Developer on site will be 25% of the proposed total number of residential units, the details of which shall be agreed before the commencement of the development.

 

(2) That, upon the satisfactory conclusion of such an agreement, the Council grant permission for the reasons adopted by Members at the meeting and subject to the following conditions:-

 

1.   Before the commencement of the development, details of the layout, scale, appearance, and landscaping of the site shall be submitted to, and approved by, the Local Planning Authority and the development shall be carried out in accordance with the approved details.

 

2.   The permission, hereby granted, shall relate to the area shown outlined in red on the approved site plan received 18th December, 2008.

 

3.   Detailed plans to be submitted in accordance with this permission shall include a proposed access drive of minimum width 5 metres and separate footpath 2 metres in width. Such approved footpath details shall be segregated from the access road and shall be implemented before the development is first occupied.

 

4.   Prior to the commencement of development, hereby approved, a scheme shall be submitted to, and approved in writing by, the Local Planning Authority detailing how the use of sustainable/public transport will be encouraged.  The agreed details shall be implemented in accordance with a timescale to be agreed by the Local Planning Authority.

 

5.   Before the development is brought into use, that part of the site to be used by vehicles shall be constructed with either:-

 

(a)     a permeable surface and associated water retention/collection drainage, or;

 

(b)     an impermeable surface with water collected and taken to a separately constructed water retention/discharge system within the site.

 

The area shall thereafter be maintained in a working condition.

 

6.   Detailed plans to be submitted in accordance with this permission shall include car and cycle parking facilities for all proposed flats in accordance with the Council’s Interim Parking Standards and Cycle Parking Standards.

 

7.   Unless otherwise agreed in writing by the Local Planning Authority, no building or other obstruction shall be located over or within 3 (three) metres either side of the centre line of the water main which crosses the site.

Minutes:

Consideration was given to a report presented by the Development Control Manager which detailed the review undertaken following the move from two to three weekly intervals of Planning Board meetings.

 

Regard was given to the move to a three week Board cycle which had not had a disproportionate impact on the number of applications presented to each Board meeting showing a 32% increase in numbers compared against a 36% reduction in the number of Board meetings. 

 

Site visit numbers for the comparable period have remained consistent with no more than three visits scheduled for any one meeting. The highest number of applications dealt with during a three week Board cycle was twenty-four applications and the highest number during the two week cycle was twenty-three applications.

 

The briefing for the next Planning Board took place after the preceding Board and created greater consistency in report writing and decision making and gave more time to the Chair and Vice Chair to consider the draft agenda.

 

Applications could be deferred for site visit and still have time to be included on the next agenda resulting in a greater number of applications achieving the targets set both nationally and locally.

 

Planning application targets have continued to be met and there had been no impact on major application performance during this pilot period.

 

It is, therefore, considered that the three week Planning Board schedule had resulted in associated benefits and, together with a revised procedure to notify members of the public of their right to speak, produced a more efficient and streamlined service that should continue and the diaries produced on this basis.

 

Discussion ensued on the merits of a three weekly cycle of meetings, but queries were raised relating to:-

 

·              The length of meetings, participation by Members and the impact on the democratic decision making process.

·              Scheduling of meetings and the knock on effect.

·              Scheduling of site visits on a separate day to the scheduled Board meeting.

·              Current level of membership.

·              Commitment and choice to the Planning Board.

 

Resolved:-  That the Planning Board continue on a three week cycle for meetings beyond the pilot period and that these continue to be included in the Council’s Year Book.
