Officer Decisions

Officers exercise delegated decision making powers in respect of both non-executive and executive functions of the Council.

The present Scheme of Delegation from the Leader of the Council, which sets out how executive functions will be discharged, provides for delegated decision making by officers. Appendix 9 of the Constitution sets out the non-executive functions delegated to officers. All executive functions, other than those reserved by Cabinet, may be discharged by officers.

The Chief Executive and Strategic Directors of the Council have established their own sub-schemes of delegation detailing which and how both non-executive and executive functions will be discharged on behalf of the authority.

Decision records for the discharge of functions by officers are published below. These decision records set out the following information:-

30/11/2020 - (R&E) Proposed Listerdale 20mph Speed Limit ref: 1108    Recommendations Approved

To seek approval to implement a 20mph speed limit at Listerdale. The area proposed to be subject of a speed limit reduction was suggested as part of the Neighbourhood Road Safety Schemes Programme fund.

Decision published: 21/12/2020

RECORD OF OFFICER EXECUTIVE DECISION

Date of Decision:

Monday 30 November 2020

Decision Maker:

(Including Job Title)

Simon Moss, Assistant Director of Regeneration and Environment

Specific Delegation:

(If any)

None specified.

Brief Description of Decision:

The area proposed at Listerdale to be subject of a speed limit reduction was suggested as part of the Neighbourhood Road Safety Schemes Programme fund round 1. The area is predominantly residential, except for the local shopping centre situated at the Bawtry Road service road. This area forms a locus for residents utilising these facilities and accessing nearby public transport. The 20mph limit will better reflect and indicate to users the speed at which it is safer to travel throughout this area.

To enable this the Assistant Director of Planning, Regeneration and Transport has exercised his delegated powers and approves in principle the proposals shown on Drawing Number NSS/WW01/20/02 and gives authority for:

1.    The usual statutory consultations to be undertaken including consultation with the local Ward Councillors and Cabinet Member.

2.    The Assistant Director of Legal Services to prepare the draft Order and notices.

3.    The proposals to be advertised.

4.    The Order to be made subject to be there being no objections received.

5.    If any objections are received, a further report will be prepared in relation to these objections and this report will be considered by the Strategic Director of Regeneration and Environment.

Reasons for the Decision:

The scheme has been developed following a suggestion made to the Neighbourhood safety scheme fund to reduce the speed limit on certain roads in the Listerdale area.  Three seven-day traffic speed surveys have been undertaken (between 13th and 19th July 2020) to establish speeds of vehicles using: Melciss Road, Black Carr Road and Green Lane, the survey results can be found in the main report.

Details of alternative options considered and rejected:

Following the receipt of a submission to the Neighbourhood Road Safety Schemes Programme Fund by Elected Members to reduce the speed limit within the Listerdale Estate.  Traffic and speed surveys have been undertaken to progress the submission made.

Specific Delegation:

Brief Description of Decision:

The area proposed at Bradgate to implement a 20mph limit was suggested as part of the Neighbourhood Safety Scheme fund, as pedestrians use this route to access three nearby schools. It will also better reflect and indicate to users the speed at which it is safer to travel throughout this area

To enable this the Assistant Director of Planning, Regeneration and Transport has exercised his delegated powers and approves in principle the proposals shown on Drawing Number NSS/RW01/20/02 and gives authority for:

Reasons for the Decision:

The scheme has been developed following a suggestion made to the Neighbourhood safety scheme fund to reduce the speed limit on certain roads in the Bradgate area.

Three seven-day traffic speed surveys have been undertaken to establish speeds of vehicles using Bradgate Lane, Fellowsfield Way and Manor Approach.  It is considered that when adjustment is made for the higher speeds noted recently, and whilst traffic levels are significantly lower due to the Covid 19 situation, the  results listed in the main report are commensurate with the proposed speed limit of 20mph.

Details of alternative options considered and rejected:

Following the receipt of a submission to the Neighbourhood Road Safety Schemes Programme Fund by Elected Members to reduce the speed limit within the Bradgate area, traffic and speed surveys have been undertaken to progress the submission made.

(If any)

The Property Officer is authorised in accordance with Appendix 5 of the Constitution of the Council, Financial and Procurement Procedure Rules Part 1 – Sections 27.9 through 27.13 to carry out functions on behalf of Council and the Executive

Brief Description of Decision:

Swinton town centre previously consisted of several public service provisions as well as independent and national retailers. Over the last few years various services have been relocated and buildings demolished leaving a cleared site which needs redevelopment. A regeneration proposal was sought which would bring about a community focussed redevelopment of the town centre alongside new family housing provision.

In order to enable this the delegated authority to agree any land disposal required, the appointment of the preferred bidder and finalise the development agreement regarding the consent to the transfer of the detailed land at Station Street, Swinton at a nil (£0) consideration in lie of the Capital Works to the retained land as detailed in Appendix 1 of the officer’s report is approved.

The Development Agreement and therefore disposal will be conditional upon the achievement of Planning, proof of clean title and site investigation.

Reasons for the Decision:

A report was presented to Cabinet in December 2018 where Cabinet approved the aims and objectives for the redevelopment of Swinton Town Centre and that an OJEU compliant procurement process be undertaken to appoint a developer partner. In January 2020 a further report was presented to Cabinet concluding the procurement process and endorsing the appointment of the chosen developer partner and the proposed scheme.

Delegated authority was given to the Council’s Property Officer, in consultation with the Strategic Director of Finance and Customer Services, the Head of Legal Services and the Cabinet Member for Jobs and the Local Economy, to agree any land disposal required, the appointment of the preferred bidder and finalise the development agreement.
